Charta OSN jako mezník v mezinárodním právu?

This year’s 80th anniversary of the end of the Second World War and the founding of the United Nations is certainly a good reason to remember 1945 as a legal landmark in international law. In the historiography of international law, the UN Charter is usually considered a landmark. This article presents an analytical and critical perspective on the UN Charter, motivated by the desire to show that its adoption, while an important landmark, involves elements of both discontinuity and continuity in the development of international law. In other words, in post-1945 international law, including the text of the Charter itself, we find elements of the old (existing) international law as well as some new elements. Therefore, the aim of this article is to distinguish and show in the UN Charter both new elements and provisions that represented only certain goals and promises, but the text of the Charter did not yet bring new rules, but also elements of continuity, where the Charter builds on older rules and institutions.

Letošní 80. výročí konce druhé světové války a založení Organizace spojených národů představuje určitě dobrý důvod pro připomenutí si roku 1945 jako právního mezníku v mezinárodním právu. V historiografii mezinárodního práva, což je dnes obecně uznávaná specializace v rámci širokého vědního oboru mezinárodního práva, se obvykle Charta OSN považuje za významný mezník. Tento článek představuje analytický a kritický pohled na Chartu OSN, motivovaný snahou ukázat, že její přijetí je sice důležitým mezníkem, ale zahrnuje prvky diskontinuity i kontinuity ve vývoji mezinárodního práva. Jinak řečeno, v mezinárodním právu po roce 1945, včetně samotného textu Charty, najdeme prvky starého (dosavadního) mezinárodního práva i některé nové prvky. Cílem tohoto článku je proto rozlišit a ukázat v Chartě OSN jak nové prvky, tak ustanovení, která představovala jen určité cíle a přísliby, avšak text Charty ještě nová pravidla nepřinesl, ale také prvky kontinuity, kde Charta navazuje na starší pravidla a instituce.
