Wymogi formalne niezbędne do pełnienia służby w Agencji Bezpieczeństwa Wewnętrznego i Agencji Wywiadu – wybrane aspekty.

Głównym celem niniejszego artykułu było przedstawienie zagadnienia odnoszącego się do warunków formalnych umożliwiających nawiązanie stosunku służbowego z funkcjonariuszem Agencji Bezpieczeństwa Wewnętrznego oraz Agencji Wywiadu. Wszystkie te warunki, które powodują możliwość nawiązania takiego stosunku pomiędzy kandydatem a powyższymi formacjami, są wymienione w treści art. 44 ustawy o Agencji Bezpieczeństwa Wewnętrznego oraz Agencji Wywiadu. Zostały one przedstawione i omówione w poszczególnych częściach artykułu. Przed nawiązaniem więzi między stronami stosunku służbowego kandydat do służby musi uczestniczyć w postępowaniu kwalifikacyjnym i spełniać takie wymogi, jak posiadanie obywatelstwa polskiego, pełnia praw publicznych oraz nieskazitelna postawa moralna, patriotyczna i obywatelska. Kandydat musi mieć wykształcenie co najmniej średnie i odpowiednie kwalifikacje zawodowe oraz zdolności fizyczne i psychiczne do pełnienia służby w formacjach uzbrojonych o szczególnej dyscyplinie służbowej, której gotów jest się podporządkować. Te wszystkie wymagania muszą być spełnione w chwili przystąpienia do postępowania kwalifikacyjnego. Kandydat jest ponadto zobowiązany do złożenia wszystkich wymaganych dokumentów i uczestniczenia w różnych testach i egzaminach. Po zakończeniu postępowania ze skutkiem pozytywnym może zostać przyjęty do służby. Warte podkreślenia jest także to, że te wymogi nie tworzą stosunku służbowego, ale mają na niego duży wpływ. Nie tylko pozwalają na jego zainicjowanie, lecz także determinują jego byt.

The main research aim of this article was to introduce problems concerning formal conditions enabling the establishment of service relationship with functionary of the Internal Security Agency and the Intelligence Agency. All conditions that cause ability to establish relationship between candidate and above formations are listed in the text of Art. 44 Act of the Internal Security Agency and the Intelligence Agency. They are included in the 5 points of this regulation. They are presented and discussed in the individual parts of this article. Before establishing ties between sides of service relationship, a candidate must attend qualification procedure. Candidate for service has to possess all requirements like being a Polish citizen, having full civil rights, having impeccable moral patriotic and civic attitude, having at least secondary education and appropriate professional qualifications and being in a good physical and mental condition to serve in the armed forces subjected to a special service discipline which he or she is ready to obey and he or she must guarantee keeping safe undisclosed information. Moreover a candidate has to possess them at the time of attending qualification procedure. Next, he has to submit all required documents and attend various tests and exams. When he passes all of them positively, he can be accepted for service. It is very important to say that this requirements do not form the structure of the service relationship, but they have a major impact on it. They not only allow it to initiate, but even determine its existence.
