The text deals with the issue of the concurrence of care benefits and social security benefits regulated in the Act on Family Benefits. Such a situation occurs when a person who already has the right to a social insurance benefit, e.g. a retirement pension, acquires the right to one of the care benefits, e.g. an attendance benefit. The regulations included in the Act on Family Benefits are discussed against the background of the general principles according to which a particular type of risk can be protected with only one benefit and social insurance benefits take precedence over care benefits. According to the author’s opinion, the solutions adopted by the legislator are unadjusted to the current situation and are increasingly provoking controversy in practice and, consequently, in the author’s opinion, require changes. The lack of action on the part of the legislator causes courts to play its role, which should not occur in a properly functioning legal system based on the rule of the tripartite division of power.

The article is about deinstitutionalisation of long-term care for people with disabilities and the elderly. In the first part there is a chronology of changes in public policy for the disabled. It shows that, the policy led to deinstitutionalisation and basing on community services. Then, the certain contemporary institutions are presented, such as personal attendance. Next part is devoted to the elderly care. That field of public policy became in Sweden more and more deinstitutionalized and community oriented. Article mentions also about current trend in home care provision and some other measures that shall support the frail elderly in the local community.

Artykuł podejmuje problem deinstytucjonalizacji opieki długoterminowej i wsparcia wobec osób z niepełnosprawnościami oraz osób starszych. W pierwszej części omówiona została ewolucja szwedzkiej polityki wobec osób niepełnosprawnych, którą cechowało zmierzanie w kierunku deinstytucjonalizacji i normalizacji uczestnictwa osób niepełnosprawnych w głównym nurcie życia społecznego. Zostały przedstawione podstawowe instrumenty wsparcia osób niepełnosprawnych, ze szczególnym uwzględnieniem zasiłku na zakup usług asystenckich. Omówiono politykę wobec osób starszych, która również od czasu II wojny światowej zmierzała w kierunku coraz większej deinstytucjonalizacji. Zaprezentowano różne formy wsparcia seniorów w Szwecji w miejscu zamieszkania. Szczególnie dokładnie zostały omówione domowe usługi opiekuńcze oraz procesy, jakim podlegało ich przyznawanie i świadczenie od lat 90. Przedstawione są też inne formy wsparcia, umożliwiające uczestnictwo osób sędziwych w społeczeństwie.
