The aim of this article is twofold. First, it provides an overview of theoretical background of casino taxation. Second, it analyses the provisions of the Act regulating casino taxation in Poland and evaluates the consequences of the new Gambling Law in force since 2010. The first section of it discusses motives, outcomes and forms of casino taxation, taking into account inter alia the assumptions of optimal tax theory. It then deals with Polish regulations concerning the organisation of gambling in casinos and gambling tax design. The last section of the article analyses the scale of operation of Polish casinos, their revenues and the tax due on gambling activities.

This article presents the comparison between provisions of freedom of economic activity act and the law on gambling in scope of conditions related to revoking concession for operating casino games. To revoke that concession, only provisions of law on gambling can be applied because of provisions of freedom of economic activity act are excluded in that cases. That regulation allows the raising of freedom economic activity, but the other hand — also causes the limitation in the protec­tion of public interest.

At the casino, Frédérique abandons herself to the roulette wheel, which gives her a protective “out of reach” place. A moment of oblivion, gambling gives her intense vertigo and appears to be a form of abandonment, an act of revolt against the diktats of society. It is also defined as an ordalic practice, meaning that the character relies on chance. As a kind of pharmakon, the game provides a feeling of omnipotence, curbing the heroine’s anguish but also proving to be mortifying. Frédérique, the specular double of an author in the grip of ontological anguish, quickly slips into gambling madness. Is the game really beneficial? Does it have a cathartic effect on the character? Or, on the contrary, is it pure fantasy, an illusion incapable of fulfilling the heroine’s fantasies, except for a brief interlude outside reality?

Au casino, Frédérique s’abandonne à la roulette qui lui confère un lieu protecteur « hors d’atteinte ». Moment d’oubli, le jeu lui procure un vertige intense et apparaît comme une forme d’abandon, un acte de révolte contre les diktats de la société. Il se définit aussi comme une pratique ordalique signifiant que le personnage s’en remet au hasard. Sorte de pharmakon, le jeu procure un sentiment de toute puissance en jugulant l’angoisse de l’héroïne, mais en se révélant également mortifère. Frédérique, double spéculaire d’un auteur en proie à une angoisse ontologique, bascule rapidement dans la folie des joueurs. Le jeu s’avère-t-il vraiment salutaire pour la jeune femme plongée dans l’oubli de soi ? A-t-il un effet cathartique sur le personnage ? Ne se révèle-t-il pas, au contraire, une pure chimère, une illusion incapable de combler les fantasmes de l’héroïne, si ce n’est le temps d’une parenthèse hors du réel ?

Exclusion of application general negative premises of granting a concession from the entrepreneurs law in cases of granting a concession for operating casino games does not cause a limitation of protection of the public interest compared to standard which is appointed by general regulation. Premises of granting the concession for operating casino games from the law on gambling do not have a narrower scope than general negative premises of granting a concession from the entrepreneurs law. That conclusion is based on the comparison between the both regulations. Moreover, on the grounds on the previous freedom of economic activity act, a few general negative premises of granting a concession had a wider scope than premises of granting the concession for operating casino games. Simultaneously, exclusion of application general rules in cases of granting the concession for operating casino games also then was in force. Elimination a few general negative premises in the entrepreneurs law, which were applying on base of the repealed freedom of economic activity act, caused that level of the protection of public interest appointed by scope of general negative premises of granting a concession is not lower than level of the protection of public interest in cases of granting a concession for operating casino games. That solution eliminated a certain systemic inconsistency, which had existed before the entrepreneurs law came into force.

The article presents research report, conducted among students UWM, about gambling and its modern varieties. The Internet has revolutionized the game and betting on the money. In preparing the concept of the test procedure attempts to exemplify the empirical phenomena through quantitative and qualitative field research. Legal and illegal gambling have become the subject of research undertaken in 2015 by the Department of Security and Public Order UWM. The aim was to determine the significance of the problem and the impact on social security of students. The basic empirical material comes from 2015. The study was conducted on a group of 2,166 respondents. When designing the test procedure adopted hypothesis that students in a small way participate in gambling. The method of diagnostic survey and research tools in the form of a questionnaire and interview. The results obtained, the nature of the research, the area and the range does not entitle to formulate far-reaching generalizations. Carried out among students of the University of Warmia-Mazury can only serve to draw conclusions about the nature of local or comparative similar in content and scope of research in other academic centers. Analysis of empirical material allows the presentation of a number of statements, which are reflected in the assessments and opinions of the students. 1. Dissemination of the Internet has opened up new forms of practicing the legal and illegal gambling. 2. In the group of legal gambling, the most popular sports totalizator betting, sports betting, Internet hazard and slot machines. 3. Among students illegal forms of gambling are not popular. Systematic participation declares less than 3% of students. 4. In the group of illegal gambling, the most popular games are illegal casinos, slot machines and illegal betting. 5. In the dorms operate illegal casinos, a place to play cards. One quarter of respondents said that during his studies was playing cards for money. 6. Among the most effective means and methods of combating illegal gambling, respondents mention: blocking websites, changes in the law to more restrictive, prevention activities of the Police, the advertising ban illegal websites and blocking the flow of money through bank accounts. 7. Among the games that have the greatest potential for addiction, the respondents mention: slot machines, betting (bookmaking) and online gambling.
