The paper deals with protection against nuisances related to a construction of a building. The nuisances frequently take place and in connection with the increase of the density of buildings it is possible that they will become more burdensome. Protection against such nuisances may be realized at two levels: civil law and administrative. Civil law protection measures cover primarily a negatory claim and a claim for withholding the construction . Administrative law protection is possible under the provisions of the act on construction law, which enable the people living in the neighbourhood of the planned investment to participate in the proceedings concerning the construction permit and thereby provide proactive protection of their interest. Application of both civil law and administrative protection measures against nuisances related to a construction of a building is connected with difficulties: a misinterpretation of provisions, their unclear structure and a lack of legal regulation of certain essential issues like the administrative decision status in the civil proceeding. In the paper the focus is on the most important of the mentioned problems and presents the solutions.
This article focuses on answering the following questions. First of all, how to interpret the article 7301 § 11of the Polish Civil Proceedings Code. Second of all, how the position of the Polish Patent Office, which examines (until 2020 only) motions for invalidation of exclusive rights (in particular in cases of infringement of the right to a trademark or industrial design), relates to the discussed amendments to the Polish Civil Procedure Code concerning proceedings to secure intellectual property rights. Third of all, whether the competences of the Polish Patent Office are being taken over by the common courts specialised in intellectual property, or whether these are just gaining even broader powers in invalidity cases. These questions are dictated by recent amendments to the Polish Civil Procedure Code dated as of 2023. This article mainly analyses the nature of the invalidity procedure as well as the recent amendments to the Polish Civil Procedure Code in the field of intellectual property law.

Niniejszy artykuł skupia się na odpowiedzi na następujące pytania. Po pierwsze, jak należy interpretować art. 7301 § 11 k.p.c. Po drugie, jak do omawianych zmian k.p.c. dotyczących postępowania zabezpieczającego w zakresie prawa własności intelektualnej, ma się pozycja Urzędu Patentowego RP rozpoznającego (do 2020 r. wyłącznie) wnioski o unieważnienie praw wyłącznych (w szczególności w sprawach o naruszenie prawa do znaku towarowego lub wzoru przemysłowego) w ramach postępowań spornych. Po trzecie, czy dochodzi do przejmowania kompetencji Urzędu Patentowego RP, czy też sądownictwo powszechne zyskuje jeszcze szersze uprawnienia w zakresie spraw o unieważnienie. W artykule przedstawiono przede wszystkim analizę charakteru postępowania spornego oraz analizy ostatnich nowelizacji Kodeksu postępowania cywilnego w zakresie prawa własności intelektualnej.
