The article discusses the process of creating political control over the Polish Army in the period from the designation of Tadeusz Mazowiecki to the position of Prime Minister in 1989 until the establishment of institutional and legal solutions in the form of the adoption of the Constitution in April 1997. Its key moments against the backdrop of events are indicated that were taking place in Poland at that time, with emphasis on how the aid was provided to the Polish authorities by external factors. This process was not without conflicts, and its completion was possible to a large extent thanks to the help provided by the governments of Western countries and Euro-Atlantic institutions.

W artykule omówiono proces tworzenia politycznej kontroli nad Wojskiem Polskim w okresie od chwili desygnowania Tadeusza Mazowieckiego na stanowisko prezesa Rady Ministrów w 1989 r. do momentu ustanowienia rozwiązań instytucjonalno-prawnych w postaci przyjęcia ustawy zasadniczej w kwietniu 1997 r. Wskazano jego kluczowe momenty na tle wydarzeń politycznych, które zachodziły w tym okresie w Polsce z wyeksponowaniem pomocy udzielonej władzom polskim przez czynniki zewnętrzne. Proces ten nie przebiegał bezkonfliktowo, a jego zakończenie w dużym stopniu było możliwe dzięki pomocy udzielonej przez rządy państw zachodnich i instytucji euroatlantyckich.

Artykuł przedstawia pozycję prezydenta RP w strukturze władzy wykonawczej w Polsce, z uwzględnieniem stanowiska zawartego w wyroku Trybunału Konstytucyjnego w sprawie rozstrzygnięcia sporu kompetencyjnego pomiędzy prezesem Rady Ministrów a prezydentem RP (Kpt 2/08). Autor definiuje także pojęcie „zwierzchnictwa” wykonywanego przez głowę państwa nad siłami zbrojnymi (art. 134 Konstytucji RP) oraz sposób jej sprawowania zarówno w czasie pokoju (za pośrednictwem ministra obrony narodowej), jak i w czasie wojny (za pośrednictwem naczelnego dowódcy sił zbrojnych). W artykule ukazane zostały także wybrane kompetencje szczegółowe prezydenta zawarte w regulacjach ustawowych.

The article presents the status of the President of the Republic of Poland in the executive structure in Poland, taking into account the judgment of the Constitutional Tribunal on the dispute settlement between the Prime Minister and the President of the Republic of Poland (Kpt 2/08). The author also defines the Presidential power of „supreme command” over the Armed Forces of the Republic of Poland (Polish Constitution, Article 134) and the manner in which it is exercised it in times of peace (through the Minister of National Defence), as well as in times of war (through the Commander-in-Chief of the Armed Forces). The article also shows selected specific powers of the President provided for in the statutory law.
