The powers of the chairman of the communal council, as provided for in Article 21a, are clearly defined in terms of subjective and objective matter. Official instructions of the chairman of the communal council may be addressed only to the employees of the communal l office who perform organizational, legal and other tasks related to the functioning of the communal council, committees and councilors. An instruction given by the chairman of the communal council to prepare a draft resolution is in accordance with the law, if the right to a legal initiative regarding resolutions belongs to the powers of the chairman of the communal council.

The Act on the Exercise of the Mandate of a Deputy or Senator constitutes legal basis for requiring by the Deputy the access to recordings from the session of a communal council. However, there are no sanctions in case of local self-government unit’s infringement of such an obligation towards Deputies and Senators. The lack of specific legal instruments does not exclude the possibility of taking action on general terms, i.e. on the basis of provisions concerning control and supervision over local self-government. A Deputy may demand, from the chairperson of the council, an explanation of reasons for the inability of the realization of such right.

In the opinion of the author of the opinion, a communal council may include in a communal statutes issues related to interpellations and questions submitted by councillors. The provisions of the statutes in this respect may not repeat or modify the provisions of the Act on Communal Self-government, in particular the statutes of the commune may not provide for any other form of submission of these documents than a written one. There are no legal obstacles to including in the agenda of a session of the communal council an item concerning the information on the number of submitted interpellations and questions by councillors, their contents and the answers given to them.

In the Sejm’s position on the Leszno City Council’s motion, it has been stated that article 40 para. 3 3 of the Act on Communal Self-government is consistent with the Constitution to the extent in which it allows the issuance of provisions for the maintenance of order only within the scope not regulated in separate acts or other generally binding regulations. The City Council filed the motion in connection with doubts as to whether it is permissible to establish by the council of the commune, by means of issuing provisions for the maintenance of order, a ban on selling psychoactive substances known as boosters. In the Sejm’s opinion, the matter covered by these provisions for the maintenance of order has been regulated by separate acts of law and therefore it is not possible to regulate this matter differently by local law.

The article presents the municipality, and also the closest primary citizen of the political subdivisions of the Italian State. Autonomous units, equipped with its own statutes and certain competence, whose operation is guaranteed in the constitution. The author looks at community from the perspective of the Italian legislation, as entities with a public – legal and consisting of certain elements (population, territory, property), to then proceed to discuss the structure and functioning of the municipal authorities, namely the mayor, board and municipal council , the method of their choice (depending on the number of inhabitants, the majority of the system for municipalities with a population of 15 thousand., the proportion above this figure) and the tasks falling within their competence.

Celem artykułu jest prezentacja gminy, podstawowej i zarazem najbliższej obywatelowi jednostki podziału administracyjnego państwa włoskiego. Jednostki autonomicznej, zaopatrzonej we własny statut i o określonych kompetencjach, której funkcjonowanie jest gwarantowane na poziomie konstytucyjnym. Autorka spojrzy na gminy z punktu widzenia włoskiego prawodawstwa, jako na podmioty posiadające osobowość publiczno-prawną i składające się z określonych elementów (ludność, terytorium, mienie), aby potem przejść do omówienia struktury i funkcjonowania organów gminy, sposobu ich wyboru (w zależności od liczby mieszkańców – system większościowy dla gmin o liczbie ludności do 15 tys., proporcjonalny powyżej tej liczby) oraz zadań leżących w ich kompetencji.
