Prawo kolejowe do dnia dzisiejszego nie zostało wyodrębnione jako samodzielna, kompleksowa gałąź prawa. Najczęściej klasyfikowane jest ono jako dział prawa komunikacyj-nego lub transportowego a także prawa gospodarczego publicznego. Jednak, z uwagi na znaczną ilość regulacji prawnych oraz ciągłe wprowadzanie do systemu prawnego nowych kolejowych przepisów, koniecznym staje się przeprowadzenie dyferencjacji kompleksowej gałęzi prawa kolejowego. Wykorzystaniedo tego celu trzech podstawowych metod regulacji stosunków społecznych: prawnocywilnej, prawnoadministracyjnej i prawnokarnej, pozwoli usystematyzować rozproszone po różnych działach systemu prawa,kolejowe normy prawne w jednym zbiorze kompleksowej gałęzi prawa kolejowego. Tak uporządkowane i sklasyfikowane prawo kolejowe będzie miało wartość praktyczną i dydaktyczną umożliwiającą pogłębianie wiedzy w zakresie prawnych aspektów funkcjonowania transportu kolejowego w Polsce.

Railroad law until today has not been distinguished in an independent comprehensive branch of law. It is most often classified as a law department of communication or transport law as well as the public economic law. However, in view of the considerable amount of the continuous adjustment and introduction of the new provisions into the legal system, conduct-ing a comprehensive differentation of railway law is becoming necessary. Using for this pur-pose the three basic methods of regulating social relations: legal-civil, legal-administrative and legal-disciplinary will let railroad legal norms, distributed across different departments of the law system, systemize in one set of the comprehensive branch of the rail law. So ordered and classified law will have practical and educational value enabling to broaden the knowledge in the field of legal aspects of the operation of the rail transport in Poland.
