Thesis Informal relationships are very popular in modern times. The number of people choosing marriage is slowly decreasing. The author of the article discerns the similarities and differences between cohabitation and marriage. The author puts forward the thesis that it is impossible to assess whether marriage is superior to cohabitation and vice versa. Concept The author presents the definitions and legal regulations of marriage and cohabitation. Additionally she lists the types of cohabitation and types of marriage. Results and conclusion In times of "liquid postmodernity" one should accept the coexistence of marriage and cohabitation, without assessing which of these forms is better, more beneficial, richer. Originality/Cognitive value In the subject literature cohabitation is presented as a short-term relationship, deprived of mutual obligations of partners, based only on sexual attachment and living together. It stands in opposition to marriage, which is as a permanent relationship based on mutual obligations of spouses and a strong emotional bond.

Set in the context of early 20 th century Malaya, W. Somerset Maugham’s (1874–1965) short story “The Force of Circumstance” (1926) concisely represents the conflicting attitudes to sex and family life among the British colonial employees. The narrative, which develops around the main hero Guy’s relationships with his English wife Doris and an unnamed Malay concubine, reflects a contrast between the attitudes to sex dominant in the official imperial ideology of that time and the practice in the colonies. The frameworks of narratology and Cognitive Poetics make it possible to read the complicated situation of the main hero as an extended metaphor of the British Empire, in which formal and informal family relations map onto the relations between Great Britain and the dependent states. Though the British imperial ideology used the concept of family to strengthen the relations between the metropole and the colonies, Maugham’s story represents the Empire as a not-so happy family – a result of circumstances rather than of mutual bond and consent.

The Supreme Court’s resolution of 25 February 2016 states that the statutory term „person in cohabitation” permits the absence of gender difference, extending in practice new civil and criminal-procedural rights of homosexual couples. It also points to physical, spiritual and economic ties between partners, but if one of them is objectively justified, it does not change the nature of a relationship at all. This is the same field for numerous abuses. Resolution breaks as a consequence with the dominant and long-established case law and opinion of doctrine, degrading role and social mission of the family. As a result of the broad and inconsistent interpretation of notion as well incompatibility with argumentation of the Constitutional Tribunal the use of term for specific situations can cause a number of interpretational doubts and deepen legal chaos.

Aim: Modern marriages are concluded based on much greater freedom in perceiving marriage as a social obligation, autonomy of both partners and – to the largest extent – they form a legalized relationship preconditioned by emotional needs. Similar characteristics are part of cohabitation, with the exception of its formalization in the legal sense. Methods: The author of the article strives to illustrate the similarities and differences between cohabitation and marriage without attempting to assess which of these relationships is more valuable. Results: The author of the article presents and discusses theoretical assumptions, legal regulations and models of cohabitation and marriage. Differences and similarities between marriage and cohabitation were shown. Conclusions: In the opinion of the author of the article, reflections on the superiority of marriage to cohabitation are not justified. Such an evaluation is stymied by many factors. One of them is the lack of precise definition of a consensual relationship, what its time frames are, what the issue of parenthood looks like in it, what is the division of home duties etc.

Cel: Współczesne związki małżeńskie konstytuowane są w oparciu o dużo większą wolność w rozumieniu małżeństwa jako społecznego obowiązku, autonomię obojga partnerów oraz – w największej mierze – stanowią zalegalizowaną relację uwarunkowaną potrzebami uczuciowymi. Podobne założenia przyświecają kohabitacji, z wyłączeniem jej formalizacji w sensie prawnym. Metody: Autorka artykułu stara się przybliżyć podobieństwa i różnice pomiędzy kohabitacją a małżeństwem bez próby oceny, która z tych relacji jest bardziej wartościowa. Wyniki: W artykule przedstawiono i omówiono założenia teoretyczne, uregulowania prawne oraz modele kohabitacji i małżeństwa. Wykazano różnice oraz podobieństwa pomiędzy małżeństwem i kohabitacją. Wnioski: W przekonaniu autorki artykułu rozważania nad wyższością małżeństwa wobec kohabitacji nie są zasadne. Wartościowanie takie utrudnia zresztą wiele czynników. Jednym z nich jest brak dookreślenia, czym jest związek konsensualny, jakie są jego ramy czasowe, jak wygląda w nim kwestia rodzicielstwa, podziału obowiązków domowych etc.
