Problematyka zbiegu egzekucji administracyjnej i sądowej nieustannie wywołuje w doktrynie i orzecznictwie szereg wątpliwości. w artykule zwracam uwagę na konsekwencje różnorodności przepisów o zarządzie w administracyjnej i sądowej egzekucji z nieruchomości. Stwierdzam, że różnica w zakresie regulacji prawnych jest na tyle istotna, że często wyklucza możliwość przekazania egzekucji jednemu z organów egzekucyjnych do łącznego prowadzenia bez uszczerbku dla praw uczestników postępowania egzekucyjnego, tym samym rozstrzygnięcie sądu wbrew ogólnym zasadom przybiera charakter materialnoprawny.

The confluence of administrative and judicial executions creates a number of concerns arising from incompatibilities in doctrine and case law. In this paper the attention is paid to the consequences of differences in the regulations on the management of the administrative and judicial enforcement of property foreclosures. It is concluded that the regulatory differences are so significant that they often exclude the possibility of executing transfer to one of the law enforcement agencies without prejudice to the rights of the parties. In that case, when the court makes a decision its actions become a substantive, contrary to the general principles.
