Artykuł ten dotyczy roli prawnoustrojowej Prezydenta RP w procesie powoływania Rady Ministrów na gruncie regulacji Konstytucji Rzeczypospolitej Polskiej z 2 kwietnia 1997 roku na tle praktyki konstytucyjnej. W pracy poruszono zagadnienia kompetencji Prezydenta we wszystkich przewidzianych przez ustawę zasadniczą trybach tworzenia rządu. Autor dokonał analizy relacji prawnych i ustrojowych między Prezydentem a Sejmem RP w kontekście procedur tworzenia gabinetu. Pozycja ustrojowa głowy państwa determinowana jest także przez czynniki o charakterze politycznym, co zostało uwzględnione.

Abstract: This article concerns the legal role of the President of the Republic of Poland in the process of appointing the Council of Ministers under the Ordinance of the Constitution of the Republic of Poland of 2 April 1997 in the context of constitutional practice. The article deals with the competence of the President in all the modes of government formation provided for by the Constitution. The author analyses the legal and systemic relations between the President and the Sejm of the Republic of Poland in the context of procedures for the formation of the cabinet. The position of the head of state is also determined by political factors which are mentioned.
