Poland belongs to the circle of European states in which it is permitted that the participants of penal procedure can come to agreement. The codification of 6th June, 1997, introduced two reforms of consensual complementary dispute resolution: conviction without a trial in art. 335 of penal code and conviction in line with the limited trial in art. 387 of penal code is defined by a common term of entering a no contest plea. In principle, the goal of the institution under discussion is to accelerate and make more effective the penal trial. If in technical literature this institution was generally accepted, in practice, despite the fact that it has been functioning for 14 years, it still arouses doubts. It follows mainly from the fact that there is no unanimous regulation of the rules. One should pay special attention to the fact that the aggrieved party has not been taken into consideration in art. 335 of the code of criminal procedure. One should then postulate to change this regulation because in practice it leads to abuses.

Niniejszy artykuł przedstawia rozwój porozumień procesowych w polskim postępowaniu karnym. Ukazuje kolejne liczne nowelizacje przepisów regulujących instytucje skazania bez rozprawy i dobrowolnego poddania się karze. Artykuł stanowi też próbę oceny obecnego znaczenia porozumień procesowych w polskim wymiarze sprawiedliwości. W artykule zaakcentowane więc zostały zalety konsensualizmu, ale naświetlono w nim także możliwe koszty i zagrożenia z nim związane

This paper examines the evolution of different forms of consensual finalization of polish criminal proceedings. It shows numerous amendments of regulations in conviction without a trial and voluntary submission to criminal responsibility. The paper also attempts to access the current importance of consensual finalization of criminal proceedings for polish justice. Therefore the paper stresses the advantages of conviction without a trial and voluntary submission to criminal responsibility, but also highlights its possible costs and threats.

The subject of the following study is to show the institution of conviction without a trial in time perspective and the impact of the regulations of other countries on the current nature of this institution. Similarity of conviction without a trial to Italian pattegiamento has been presented. The original regulation of Art. 335 of the Code of the Criminal Procedure differs significantly from the current wording and subject scope of conviction without a trial. In view of the adopted and planned changes, the attention has been paid to the protection of aggrieved party’s rights which should also be respected in modified proceedings. Changes introduced by means of the amendment of September 2013 and February 2015 have been evaluated. Changes which are currently the subject of a legislative process have been positively evaluated.

Przedmiotem artykułu jest ukazanie instytucji skazania bez rozprawy w perspektywie czasowej oraz wpływu regulacji innych państw na obecny charakter tej instytucji. Przedstawiono podobieństwo skazania bez rozprawy do włoskiego pattegiamento. Pierwotna regulacja art. 335 k.p.k. znacząco odbiega od obecnego brzmienia i zakresu przedmiotowego skazania bez rozprawy. W perspektywie zmian uchwalonych i projektowanych zwrócono uwagę na ochronę praw pokrzywdzonego, które powinny być respektowane również w postępowaniach zmodyfikowanych. Oceniono zmiany wprowadzone nowelą z września 2013 r. i lutego 2015 r. Pozytywnie oceniono zmiany projektowane, które obecnie są przedmiotem procesu legislacyjnego.
