The new law on the facilitation of debt recovery is intended to increase the contracting parties’ confidence in civil law transactions. According to the legislator, the new mechanisms will improve the situation of creditors, facilitate the collection of claims, and streamline civil law transactions. The author analyses selected provisions of the new law and indicates doubts which in his opinion will arise in the practice of applying the law. Consequently, the article questions whether the new solution can contribute to the achievement of the objectives pursued by the legislator.

Nowa ustawa o ułatwieniach w dochodzeniu wierzytelności ma za zadanie zwiększyć zaufanie kontrahentów w obrocie cywilnoprawnym. Według ustawodawcy nowe mechanizmy przyczynią się do poprawy sytuacji wierzycieli, ułatwią dochodzenie wierzytelności, uporządkują obrót cywilnoprawny. Autor poddaje analizie wybrane przepisy nowej ustawy i wskazuje wątpliwości, jakie jego zdaniem pojawią się w praktyce stosowania prawa. W konsekwencji wyraża wątpliwość, czy nowe rozwiązanie może przyczynić się do realizacji zakładanych przez ustawodawcę celów.
