O pojęciu abstrakcyjnego narażenia dobra prawnego. Rozważania z pogranicza dogmatyki i teorii prawa karnego

Na niniejszy tekst składają się rozważania o pojęciu abstrakcyjnego narażenia dobra prawnego, które jest elementem konstrukcji tzw. przestępstw abstrakcyjnego narażenia na niebezpieczeństwo. Są to rozważania interdyscyplinarne, obejmujące filozoficzno-teoretyczno-dogmatyczne konotacje tzw. przedpola naruszenia dobra prawnego. W tym zakresie dokonano krytycznej analizy teorii uzasadniających przestępstwa abstrakcyjnego narażenia i zaproponowano nową koncepcję potencjalnego zagrożenia w ujęciu ontologicznym in conreto czynu. Omówiono naukę o dobru prawnym i zaproponowano model semantyczno-ontologiczny dobra prawnego, jako nowe narzędzie metodologiczne teorii prawa karnego.

This paper is about a controversy of an abstract danger of legal good, which is an element of a construction of a type of a crime – the so called crime of an abstract exposure to danger. The discussion includes a philosophical-theoretical-dogmatical connotations of a rechtsgutschutz- based prohibited behaviour. In the scope of this a critical analysis has been made concerning theories justifying the crime of an abstract exposure to danger and a new conception of an ontological potential in concreto conduct danger. Moreover, the legal good doctrine (Rechtsgutlehre) has been described and an ontological-semantic model of the legal good has been suggested, which ought to be understood as a new methodological tool or attitude in a theory of criminal law.
