The author of this study discusses the issue of the participation of an NGO and its character in criminal proceedings as a friend of the court (amicus curiae). Not only the historical aspects of this institution have been discussed, but also the practice of foreign courts and international judicial authorities in this regard. Subsequently, attention was focused on the problem of the presence of echoes of the institution of a friend of the court in the Polish criminal trial. The author attempts to distinguish between the institution of a social representative known from Chapter 10 of the Polish Code of Criminal Procedure and amicus curiae. The last part of the study indicates the conclusions de lege lata and de lege ferenda.

Autor tegoż opracowania omawia problematykę zagadnienia tzw. przyjaciela sądu (amicus curiae). Zwracana jest uwaga na możliwość uczestnictwa – przede wszystkim – w tym charakterze organizacji pozarządowej. Omówione zostały nie tylko aspekty historyczne tej instytucji, ale także praktyka sądów zagranicznych i międzynarodowych organów sądowniczych w tym zakresie. W dalszej kolejności uwaga została skupiona na problemie obecności echa instytucji przyjaciela sądu w polskim procesie karnym. Autor podejmuje próbę rozróżnienia instytucji przedstawiciela społecznego znanego z rozdziału 10 polskiej ustawy karnej procesowej oraz amicus curiae. W ostatniej części opracowania wskazane zostały wnioski de lege lata oraz postulaty de lege ferenda.
