The use of donor gametes has become an essential part of assisted reproduction. However, the ethical and legal issues associated with this method of involving third parties in the reproductive process are still debated. One is the tendency to commercialise the whole process, whereby large sums of money are provided to donors of gametes on a reward basis, in addition to other benefits. My intention will be to show that the same situation also prevails in the Czech Republic, where the legal rules for the provision of reimbursement of expenses related to the donation of eggs and sperm are set up in a completely vague manner, which leads to their arbitrary shaping through the practice of reproductive clinics, both in contradiction to human dignity and the universally recognized and legally enshrined requirement of solidarity and altruism.

Využívání pohlavních buněk od dárců se již stalo neodmyslitelnou součástí asistované reprodukce. Stále jsou však diskutovány eticko-právní problémy, které jsou s tímto způsobem zapojování třetích osob do procesu reprodukce spojovány. Jedním z nich jsou tendence ke komercializaci celého procesu, když jsou dárcům pohlavních buněk vedle dalších benefitů poskytovány vysoké finanční částky na principu odměny. Mým záměrem bude ukázat, že stejná situace panuje také v České republice, kde jsou právní pravidla pro poskytování náhrad výdajů spojených s darováním vajíček a spermií nastavena zcela vágním způsobem, což vede k jejich samovolnému dotváření prostřednictvím praxe reprodukčních klinik, a to jak v rozporu s lidskou důstojností, tak všeobecně uznávaným a legislativně zakotveným požadavkem solidarity a altruismu.
