The article is devoted to the analysis of the legal nature of the minimum wage in the light of international, European and Polish regulations. Author refers to the legal acts of the United Nations, the International Labour Organization and the Council of Europe, as well as to EU law, including the directive No. 2022/2041 on adequate minimum wages in the European Union. She also refers to the Constitution of the Republic of Poland and statutory provisions. Against this background, she characterizes the essence of the minimum wage and determines its relation to fair wage and decent wage. She considers the features of the minimum wage, with particular attention to mutuality and equivalence of work and minimum wage.

Przedmiotem artykułu jest analiza charakteru prawnego minimalnego wynagrodzenia za pracę w świetle unormowań międzynarodowych, europejskich oraz polskich. Autorka odwołuje się do regulacji prawnych Organizacji Narodów Zjednoczonych, Międzynarodowej Organizacji Pracy i Rady Europy, a także do prawa unijnego, w tym dyrektywy nr 2022/2041 w sprawie adekwatnych wynagrodzeń minimalnych w Unii Europejskiej. Odnosi się także do Konstytucji RP oraz przepisów rangi ustawowej. Na tym tle charakteryzuje istotę minimalnego wynagrodzenia za pracę i określa jego relację do wynagrodzenia sprawiedliwego i wynagrodzenia godziwego. Rozważa także cechy minimalnego wynagrodzenia za pracę, ze szczególnym uwzględnieniem wzajemności oraz ekwiwalentności minimalnego wynagrodzenia i pracy.

This study is a voice in the debate on the minimum wage policy in Poland. At the beginning the theoretical views and the results of empirical studies on the economic and social consequences of the minimum wage are discussed. The elements of the diagnosis of the situation on the minimum wage in Poland, with special attention to its value, are presented. Next, the social function of the minimum wage is considered, in the context of the phenomenon of low wages and the risk of poverty among working people. The final part of the paper contains notes on the management of the minimum wage and the need for a European minimum wage policy.

Niniejsze opracowanie jest głosem w dyskusji na temat polityki płacy minimalnej w Polsce. Na początku zaprezentowano poglądy teoretyczne oraz wyniki badań empirycznych dotyczących ekonomicznych i socjalnych konsekwencji płacy minimalnej. Następnie przedstawiono elementy diagnozy sytuacji w zakresie minimalnego wynagrodzenia w Polsce, ze szczególnym uwzględnieniem kwestii jego wysokości. Dalszym przedmiotem rozważań jest socjalna funkcja minimalnego wynagrodzenia w kontekście zjawiska niskich wynagrodzeń i ryzyka ubóstwa wśród osób pracujących. Końcowa część opracowania zawiera uwagi na temat zarządzania płacą minimalną oraz potrzeby europejskiej polityki płacy minimalnej.
