A failure to perform public procurement on time is an adverse situation that frequently has serious organisational, economic and legal consequences. Being behind schedule in public procurement is a frequent finding in audits, subject to an assessment, also in the engagements of the Supreme Audit Office of Poland. A recent judgment by the National Appeals Office (Polish: Krajowa Izba Odwoławcza) triggered a discussion in the area, which sheds light on when we should refer to a delay and when to a default in public procurement obligations, what is the difference between a delay and a default and their consequences, especially relating to contract obligations, including contractual fines of a public procurement contractor. The conclusions of the article are not destined as an exhaustive commentary on the said judgment, though, because they are partially related to the issue – when regarded from the perspective of the state of the case – that has been emphasised for the purposes of the topic of this article

Niedotrzymywanie terminów w zamówieniach publicznych jest często stwierdzane i oceniane w toku działalności kontrolnej. Okazję do podjęcia rozważań na ten temat stwarza niedawny wyrok Krajowej Izby Odwoławczej, w świetle którego warto zastanowić się, kiedy można mówić o opóźnieniu i zwłoce w wykonaniu zobowiązania, jakie są różnice między tymi pojęciami oraz skutki związane z opóźnieniem i zwłoką, zwłaszcza w odniesieniu do odpowiedzialności kontraktowej, w tym obowiązku zapłaty kary umownej przez wykonawcę zamówienia publicznego. Zawarte w artykule uwagi nie są jednak pomyślane jako glosa do wyroku. Dotyczą wybranego zagadnienia zarysowanego w tytule opracowania, związanego ze stanem faktycznym sprawy.
