This paper analyses two issues: first, the possibilities for corrections of Lithuanian civil service legal regulation, deliberating on a more flexible regulation perspective. It discusses whether the narrowing of civil service legal regulation could become a potential way to increase the efficiency of public administration with respect to the Lithuanian legal system. It also evaluates the possibilities of discretionary power use in the civil service. Another issue is the possibility of Lithuanian civil servants and public sector employees' statuses change, emphasizing existing problems and alternative considerations that may lead to the correction of the concept of servant in the future. The need for special civil servant status and responsibilities are discussed, as well as the possibilities to extend, narrow or eliminate the corps of civil servants. The paper is based on the data from qualitative research carried out in 2011 in the form of semi-structured interviews with more than fifty of the highest level Lithuanian civil servants, politicians responsible for civil service, and other experts-practitioners of the field.

The article assesses the impact of the legal acts of the President of the Republic of Poland on individual legal standing. Anyone may in virtue of the President’s actions, satisfy their legal interest and acquire rights. Potential admissibility of administrative court’s review of the President’s executive competences is also discussed. A majority of the scholarly opinions and of jurisdiction is that neither common nor administrative courts have the competence to assess is actions of the highest state authority in this matter. No jurisdiction in this scope prevents administering justice and thus is an obstacle in exercising fundamental rights by an individual. The article presents arguments for and against recognition of the administrative court’s competence and potential effects of legal review.

Discretionary power, a central feature of administrative power, comes into play when administration is called to select an option between two or more solution and a way of balancing between public and private interests. After the 20th century, devastated by wars, public deficit and debt, most State models circumscribed their markets to the detriment of the global one, turning the old economic models into new ones after the 1958 Treaty of Rome and, after the phase following the Maastricht Treaty of 1992, and the crisis of 2008, the final concept is that the EU Members States should restructure the public finances, facing the increase of the public goods and services demand and with the rested rights. The purpose of this article was to enquire whether the European and national rules may limit the discretionary power while expanding the administrative one.

Władza dyskrecjonalna jako główna cecha władzy administracyjnej ma miejsce wówczas, gdy administracja jest upoważniona do przypisania konkretnego znaczenia, dokonując wyboru spośród kilku możliwości, który jest sposobem zrównoważenia interesów publicznych i prywatnych. Po XX stuleciu, zdewastowanym wojnami, deficytem publicznym i długiem, większość modeli państwowych ograniczyła swoje rynki ze szkodą dla rynku globalnego, zmieniając stare modele ekonomiczne w nowe po traktacie rzymskim z 1958 r., traktacie z Maastricht z 1992 r. i kryzysie, jaki nastąpił w 2008 r. Ostateczną propozycją jest to, że państwa członkowskie UE powinny zrestrukturyzować finanse publiczne w obliczu wzrostu popytu na dobra publiczne i usługi. Celem artykułu było zbadanie, czy regulacje europejskie i krajowe mogą ograniczać uprawnienia dyskrecjonalne przy rozszerzaniu zakresu przepisów administracyjnych.

Artykuł ukazuje istotną rolę sędziego sądu administracyjnego w procesie konstytucjonalizacji instytucjonalnej. Władza dyskrecjonalna sędziów administracyjnych wynika z działań podejmowanych w ramach przyjętych strategii orzeczniczych, których wartość wyraża się w uwzględnieniu potrzeby budowania podstaw dla możliwości prowadzenia jak najszerszego dialogu w obszarze zarówno konstytucyjnym, jak i europejskim. Krytyka judykatury uzasadnia twierdzenie, że w zakresie dotyczącym wykładni prawa zasady konstytucyjne i zasady prawa europejskiego mają istotne znaczenie, ugruntowane już pewną tradycją, co powoduje, że koncepcja prawa jest relatywnie szeroka i stanowi przedmiot wspomnianego wyważania przy rozstrzyganiu konkretnej sprawy.

The article demonstrates the relevant role of the administrative court judge in the process of institutional constitutionalisation. The discretionary power of the administrative judges is provided by the activities undertaken within the framework of the adopted jurisprudential strategies, whose value is expressed in taking into account the need to build the foundations for the possibility of carrying out the widest possible dialogue both in the constitutional and European fields. The criticism of the judicature justifies the claim that to the extent relating to the interpretation of law, the constitutional principles and the principles of the European law bear significant importance, established already by a certain tradition, which causes the scope of the concept of law to be relatively wide and subject to the said balancing while adjudicating a specific case.
