Procedural Justice in the Courtroom: The Factor Structure and Psychometric Properties of the Revised Procedural Justice Scale

In Polish psychology there has been no systematic research so far on the experience of contact with courts and on the evaluation of this experience using the theory of procedural justice. Polish psychologists do not have Polish instruments measuring procedural justice at their disposal. The Procedural Justice Scale is a measure operationalizing the dimensions of procedural justice according to Tyler’s model: respect, neutrality, voice, understanding, and influence. The aim of the present article is to present the work on the revised version of the Procedural Justice Scale, measuring procedural justice operationalized exclusively in psychological terms, and to present the psychometric properties of this scale. In particular, the author tested the reliability of the instrument and verified its validity based on confirmatory factor analysis, scale intercorrelations, and intergroup differences. The results confirmed the five-factor structure of procedural justice. They also confirmed the criterion validity of the measure, reflected in correlations with validation instruments.

The modernization of justice systems is currently being discussed in most European countries. Law seeks new possibilities that could serve as an alternative to standard judicial procedures. These include mediation. The original theoretical-empirical study responds to the urgent demand for relevant and up-to- date information on the application of mediation in the Member States of the European Union. The authors have used an interdisciplinary approach in which a sociological and socio-geographical point of view is applied. They mainly focused on applying the institute of the first meeting with a registered mediator. Based on statistical data obtained from the Ministry of Justice of the Czech Republic, a spatial analysis of the use of the institute of the first meeting with a registered mediator in civil court proceedings was conducted by district courts of the Czech Republic. Maps have been created to provide a spatial view of its distribution. For a more comprehensive approach, the authors supplemented them with an analysis of the types of disputes in which the first meeting with a registered mediator has been ordered by the district courts. It turns out that the application of the first meeting with a registered mediator is strongly spatially concentrated. At the same time, some relationships and factors that determine this spatial differentiation have been identified. A unique interdisciplinary interest on mediation in the Czech Republic is the result of the long-term research focus of the Faculty of Law in Olomouc as well as in Brno.

Ve většině evropských zemí je v současné době řešena otázka modernizace justičních systémů, na jejímž základě právo hledá nové možnosti, které by byly alternativou ke standardním soudním postupům. K nim patří i mediace. Původní teoreticko-empirická studie reaguje na naléhavou poptávku po relevantních a aktuálních informacích uplatňování mediace v členských státech Evropské unie. Autoři využívají mezioborového přístupu, ve kterém je uplatněn zejména sociologický a socio-geografický pohled. Specificky se zaměřují na aplikaci institutu prvního setkání se zapsaným mediátorem. Na základě statistických dat získaných od Ministerstva spravedlnosti ČR byla provedena prostorová analýza využívání institutu prvního setkání se zapsaným mediátorem v rámci civilního soudního řízení okresními soudy ČR. Byly vytvořeny mapy poskytující prostorový pohled na jeho distribuci. Pro komplexnější pojetí je autoři doplnili analýzou typů sporů, ve kterém bylo první setkání se zapsaným mediátorem okresními soudy nařízeno. Ukazuje se, že aplikace prvního setkání se zapsaným mediátorem je silně prostorově koncentrována. Současně byly identifikovány některé souvislosti a faktory, které tuto prostorovou diferenciaci podmiňují. V České republice ojedinělý mezioborový zájem o mediaci je výsledkem dlouhodobého výzkumného zaměření pracovníků olomoucké a brněnské právnické fakulty.
