Celem niniejszego artykułu jest analiza sektora ciepłowniczego pod kątem jednostronnych praktyk antykonkurencyjnych stosowanych przez przedsiębiorstwa działające na lokalnych rynkach ciepła. Brak wprowadzenia zasady unbundlingu w sektorze ciepłowniczym oraz problematyczna kwestia realizacji dostępu strony trzeciej do sieci powoduje, że przedsiębiorstwa ciepłownicze stosunkowo chętnie dopuszczają się nadużywania pozycji dominującej zajmowanej na lokalnym rynku ciepła. Dla przedstawienia jednostronnych praktyk antykonkurencyjnych poza wskazaniem charakterystycznych cech sektora w niniejszym artykule wykorzystano także praktykę decyzyjną Prezesa UOKiK.

The aim of this article is to analyse the district heating sector in the context of unilateral anti-competitive behaviours of companies acting on local district heating markets. The lack of an ‘unbundling’ rule in the district heating sector, and the problematic issue of ‘third party access’ results in companies being relatively more willing to abuse their dominant positions held in local markets. The decision-making practice of the President of UOKiK, the Polish NCA, has been presented in order to better illustrate such unilateral behaviours alongside a description of the characteristic features of the district heating sector.

Celem niniejszego artykułu jest próba oceny zasadności wprowadzenia na rynek ciepła regulacji dotyczących dostępu strony trzeciej (Third Party Access; dalej: TPA). O ile zasada ta skutecznie realizowana jest na rynkach energii elektrycznej i paliw gazowych, o tyle powstaje wątpliwość czy specyfika rynków ciepła pozwala na jej pełne stosowanie. Istotne jest również zidentyfikowanie potencjalnych problemów związanych ze stosowaniem zasady TPA na lokalnych rynkach ciepła.

The main aim of this article is to evaluate the introduction of the Third Party Access (TPA) rule on district heating markets. Although the TPA rule has been successfully implemented on electricity and gas markets, many doubts can be expressed concerning its suitability to district heating systems. It is also essential to properly define potential challenges connected with the introduction of TPA especially on local district heating markets.
