Wykonywanie pracy lub innych zajęć zarobkowych przez dziecko w sporcie

The thesis of this study is based on the recognition that the current legal regulation regarding the performance of work or other paid activities by a child in modern sport is sufficient. The performance of work by children is becoming increasingly practical, because usually the condition for achieving success in senior sports at the highest level is to start training at the age of only a few years. The Labor Code introduces art. 304 [5], which allows children to perform work or other gainful activities after meeting a number of criteria contained in this legal provision. This study presents a detailed analysis of this regulation, and then transfers these considerations to the ground of modern practice in sport. The author in this study relies on many independent levels - both code regulations - labor code, civil code, family and guardianship code, internal regulations of Polish sports associations, as well as practice.

U podstaw tezy niniejszego opracowania leży uznanie, że obecna regulacja prawna w zakresie wykonywania pracy lub innych zajęć zarobkowych przez dziecko we współczesnym sporcie jest wystarczająca. Wykonywanie pracy przez dzieci nabiera coraz większego znaczenia praktycznego, bowiem zazwyczaj warunkiem osiągania sukcesów w sporcie seniorskim na najwyższym poziomie jest rozpoczęcie treningów w wieku zaledwie kilku lat. W kodeksie pracy wprowadzono art. 304[5], który pozwala dzieciom na wykonywanie pracy lub innych zajęć zarobkowych po spełnieniu szeregu kryteriów zawartych w tym przepisie prawnym. W niniejszym opracowaniu przedstawiono szczegółową analizę tej regulacji, a następnie przeniesione te rozważania na grunt współczesnej praktyki w sporcie. Autor w niniejszym opracowaniu sięga do wielu niezależnych od siebie płaszczyzn – zarówno do regulacji kodeksowych – kodeksu pracy, kodeksu cywilnego, kodeksu rodzinnego i opiekuńczego, do regulaminów wewnętrznych polskich związków sportowych, jak również do praktyki.
