The decision of the Voivodeship Administrative Court in Białystok concerns the rules for handling the documentation of court cases, which, after a certain period of time, the court archive no longer has to be kept by the court. If such documentation does not have the status of archival material, it is allocated to waste paper (i.e. to be destroyed). The problem which the ruling concerns is the question of whether the files of court cases to be destroyed can be handled differently, in particular whether they can be sold to one of the parties to the court proceedings. The authors consider the above issue through the prism of binding regulations in the field of archival law.

Postanowienie dotyczy zasad postępowania z aktami spraw sądowych, których po upływie pewnego czasu archiwum sądu nie musi dłużej przechowywać. Jeśli dokumentacja tego typu nie ma statusu materiału archiwalnego, jest przeznaczana na makulaturę (tzn. do zniszczenia). Problem, którego dotyczy postanowienie, sprowadza się do pytania, czy z aktami przeznaczonymi do utylizacji można postąpić inaczej, w szczególności sprzedać je jednej ze stron postępowania. Autorzy glosy rozważają powyższe zagadnienie przez pryzmat obowiązujących przepisów z zakresu prawa archiwalnego.

Podstawą prawa archiwalnego w Polsce jest Ustawa o narodowym zasobie archiwalnym i archiwach z 1983 r., którą wielokrotnie nowelizowano. Ostatnia zmiana ustawy (2015) m.in. rozszerzyła uprawnienia kontrolne administracji archiwalnej, a także pociągnęła za sobą konieczność wydania do niej nowych aktów wykonawczych. Zmodyfikowały one funkcjonujące dotąd regulacje, chociażby w zakresie brakowania dokumentacji nie archiwalnej. Ten zestaw aktów prawnych, obejmujących państwowe i samorządowe organy i jednostki organizacyjne, uzupełniają instrukcje kancelaryjne, wykazy akt i instrukcje archiwalne. Te, wydane przez Prezesa Rady Ministrów w 2011 r., po raz pierwszy określiły także sposób obiegu dokumentacji elektronicznej. Podstawy do posługiwania się tą dokumentacją obowiązują już jednak od ponad dziesięciu lat.

Polish archives law is based on the provisions of the Act on National Archive Resources and Archives of 1983, which has subsequently been numerously amended. The latest amendment (2015) included the expansion of monitoring powers for archive administration and necessitated the adoption of new implementing acts. They modified previous regulations, e.g., in the field of weeding. This set of legislative acts binding on state and local authorities and institutions is supplemented by office instructions, lists of files and archive instructions. The legislation issued by Poland’s Prime Minister in 2011 for the first time regulated the circulation of electronic documentation. However, legal bases for the use of electronic documentation have been in force for over ten years.
