Realizacja zasady oficjalności doręczeń w postępowaniach administracyjnych po wejściu w życie ustawy o doręczeniach elektronicznych

In October 2021 the act on electronic delivery will come into force. This will change the way of implementing the so-called rule of official form of service in proceedings before public administration authorities. A general principle of the equivalence of letters used to settle cases will be introduced, regardless of whether they have been prepared and recorded in electronic form or on paper. What more, the principle of priority for electronic deliveries will be introduced. This article recalls how the principle of official service is currently understood, and then it describes the changes (implemented by new regulations) in the method of service and their consequences for other procedural institutions in administrative proceedings.

W październiku 2021 r. wejdzie w życie ustawa o doręczeniach elektronicznych. Zmieni ona sposób realizacji tzw. zasady oficjalności doręczeń w postępowaniach przed organami administracji publicznej. Wprowadzona zostanie generalna zasada równoważności pism służących załatwianiu spraw bez względu na to, czy zostały sporządzone i utrwalone w postaci elektronicznej, czy też na papierze. Zacznie też obowiązywać zasada (o ile zostaną spełnione warunki określone w prawie) priorytetu doręczeń w drodze elektronicznej. Niniejszy artykuł przypomina, jak obecnie jest rozumiana zasada oficjalności doręczeń, a następnie opisuje (wdrożone nowymi przepisami) zmiany w sposobie doręczeń i ich skutki dla innych instytucji procesowych w postępowaniu administracyjnym.
