In its judgment of 6 July 2016, I OSK 1516/16, the Supreme Administrative Court ruled that proceedings initiated by the complaint referred in Art. 68 of the Act on Vehicle Drivers by a person subjected to a driving test is an administrative proceeding for the invalidation of the state driving test, which, pursuant to Art. 72 Clause 1 of the Act on Vehicle Drivers, should be concluded by an administrative decision. This means that the test taker has the right to challenge the conduct of a driving test in jurisdictional administrative proceedings, because he or she is entitled to initiate proceedings for its invalidation. It is a new, precedent-setting and favorable view for the examinee. Although it is also socially significant, because it concerns a common matter, it is impossible to agree with it, because in accordance with the intention of the legislator, the examinee is not entitled to initiate such proceedings. He or she only can signal in the complaint procedure specified in Section VIII of the Act of 14 June 1960 the Code of Administrative Procedure to the voivodeship marshal the need to initiate such proceedings ex officio.

Drivers suffering from epilepsy are commonly regarded as a threat to road safety. However, inability to use their own means of transport very often implies specific professional effects and lowers the quality of life. The aim of this study was to analyze the driving status of patients with epilepsy in Poland.Material and MethodsThe prospective study was performed using an independent questionnaire developed by the authors, consisting of 4 parts: 1) socio-demographic information, 2) clinical information, 3) driving information, and 4) opinions about patients with epilepsy as drivers. The study was conducted in November 2018–September 2019. A total of 188 patients completed this study.ResultsMore than one-quarter of the patients have a driving license. Among them, 35 individuals (accounting for 18.62% of the whole study group) said that they had received their driving license after the diagnosis of epilepsy. In 10 cases (5.32%), seizures occurred while the patients were driving and in 72 cases (38.30%) while they were traveling as passengers. Among all socio-clinical factors, having a driving license was conditioned by the marital status (p = 0.008) and education (p = 0.007). Other factors did not affect having a driving license or the time of obtaining the license (p > 0.05 for all cases). A relationship was observed between the occurrence of side effects of antiepileptic drugs and the occurrence of seizures while traveling as a car passenger (p = 0.001). Other factors did not affect the occurrence of epileptic seizures while traveling by car, either as a driver or a passenger (p > 0.05).ConclusionsA significant proportion of the respondents were of the opinion that patients with epilepsy should not be allowed to obtain a driving license, which is probably related to concerns about the occurrence of epileptic seizures while driving. It is necessary to conduct a nationwide educational and information campaign on epilepsy in various aspects.

Nowadays motorizing plays essential role in functioning of a significant part of society. It increases living comfort and money-making abilities. The legislator bearing in mind the importance of owning a vehicle allows to be a driver also for people with mental disorders. The aim of the article is to draw attention to the discrepancy between the importance of medical examinations, with particular reference to driver candidates with diseases which symptom is loss of consciousness, and the public perception of importance of these examination. The article presents the procedure of obtaining a driving license, with particular emphasis on the role of medical examination in this procedure. The whole is crowned with de lege ferenda postulates, indicating possible measures that could contribute to improving the existing legal standing

Posiadanie własnego środka transportu jeszcze dekadę temu stanowiło symbol zamożności i prestiżu. Współcześnie zmotoryzowanie jest niezbędne dla funkcjonowania dla znacznej części społeczeństwa. Zwiększa to komfort życia oraz możliwości zarobkowe. Ustawodawca mając na względzie istotność posiadania własnego pojazdu zezwala na jego prowadzenie również osobom z zaburzeniami psychicznymi. Celem artykułu jest zwrócenie uwagi na rażącą rozbieżność pomiędzy znaczeniem badań lekarskich, ze szczególnym uwzględnieniem kandydatów na kierowców u których występują choroby objawiające się utratą świadomości, a społecznym postrzeganiem ich znaczenia. W artykule przedstawiona została procedura wydania prawa jazdy, ze szczególnym uwzględnieniem roli lekarzy w tym postępowaniu. Całość wieńczą postulaty de lege ferenda, wskazujące możliwe środki, jakie mogłyby przyczynić się poprawie istniejącego stanu prawnego.

The paper considers legal liability for exceeding the permissible speed limit whilst driving (speeding) in a built-up area by more than 50 km/h. In the centre of the writer’s attention is a conflict between two regimes of liability – administrative and that determined by the law of petty offences, concurrent occurrence of both of which may result in a violation of the constitutional prohibition on dual punishment. The problem will be discussed by reference to the judgment of the Polish Constitutional Court of 11 October 2016 (ref number K 24/15), whose principledness the paper disputes to the extent that it refused to infer that the conflicting regimes of liability do give rise to a violation of the principle of ne bis in idem.

W artykule podjęto tematykę dotyczącą niezbędnych działań, jakie muszą być podjęte w celu zwiększenia liczby kierowców zawodowych.

However, the further development of transport companies is limited due to the lack of sufficient professional drivers. This article describes actions that are taken to increase the number of drivers.

The article aims to illustrate the process of obtaining permission to drive vehicles in Poland. Statutory conditions for participation in the training of candidates for drivers and the procedure for taking the state examination were presented. A lot of attention has been focused on the examination process. Presented the course of the examination procedure for the theoretical and practical. Were discussed in detail the tasks required exam. Because of the breadth and diversity of the examination procedure, the procedure is discussed in the basic category ,,B”.

Artykuł ma na celu zobrazować proces uzyskiwania uprawnień do kierowania pojazdami w Polsce. Zostały w nim zaprezentowane warunki ustawowe uczestnictwa w szkoleniu kandydatów na kierowców oraz procedura przystąpienia do egzaminu państwowego. Duża uwaga została skoncentrowana na procesie egzaminacyjnym. Zaprezentowana została procedura przebiegu egzaminu teoretycznego i praktycznego. Szczegółowo zostały omówione obowiązkowe zadania egzaminacyjne. Ze względu na obszerność i różnorodność procedury egzaminacyjnej, omówiona została procedura w zakresie podstawowej kategorii ,,B”.
