Tekst prezentuje zasady dziedziczenia ustawowego według polskiego prawa spadkowego. W zależności od tego, ilu i jak spokrewnionych spadkobierców pozostawił zmarły z niepełnosprawnością intelektualną, wskazane zostało, kto po nim dziedziczy i w jakiej części. Wobec skomplikowania tych zasad, zaprezentowane zostały one na licznych przykładach. Omówiona została nie tylko sytuacja rodziny biologicznej, lecz także adopcyjnej oraz zasady dziedziczenia ustawowego w przypadku braku rodziny. Wskazana została także procedura postępowania w odniesieniu do spadkobierców ustawowych, którzy ze względu na swoje postępowanie wobec spadkodawcy nie powinni po nim dziedziczyć – czyli instytucja niegodności.

The article discusses the issue of statutory succession by the deceased’s stepchild. In the current state of law, in the light of art. 9341 of Civil Code if the deceased leaves no spouse or relatives by consanguinity called to the succession by the law, the estate falls in equal parts to those children of the deceased’s spouse whose parents did not live to the opening of the succession. The publication points out numerous interpretation doubts on the grounds of the aforementioned provision. The question was also posed whether, in the times of changing social conditions and changes in the model of family life, it is not necessary to make changes in the law to strengthen the legal and inheritance position of the stepchildren of the deceased.

The article deals with a reservation agreement. This contract can precede a development agreement or other contracts. The reservation agreement is regulated by the new Law of May 20, 2021 on the Protection of the Rights of the Purchaser of a Dwelling or Single-Family House and the Developer's Guarantee Fund. The article is trying to clarify a legal nature of this agreement and to indicate a number of theoretical and practical problems relating to this contract.

The article deals with the different approaches to the right of representation in the regulation of the legal succession in Czech, Austrian and Polish law and with the theoretical definition of the right of representation.
