This paper deals with the current global situation of and with actual trials arising from it for different branches of human activities. In particular, the paper inquires about the possible role of private law to become the integral part of the process of essential changes of the human society. In authors opinion, the answer to this question should be affirmative. Author considers the relatively broad potential of private law to contribute to the further development of (not only Czech) society towards the achievement of both social and environmental dimension of society, in other words, towards the “responsible society”. Subsequently, author considers, how the different parts of the structure of the private law can contribute to the achievement of this goals.

This article deals with the problem of the forming an imperative of Sustainable Development. The content and ideological potential of the idea of Sustainable Development are analyzed. The necessity of introducing informational and educational policies in the course of implementation of the principles of Sustainable Development is substantiated. The main disadvantages and problems of the system of higher education in Ukraine are considered in light of the of the idea of Sustainable Development. It has been proven that the content of the concept "ecological" significantly expands the context of expediency in implementing the strategy of Sustainable Development.

In the era of global ecological crisis responsibility for the state of the biosphere (ecological responsibility) stands as one of the most important areas of human responsibility. It is impossible to analyze the phenomenon of environmental responsibility in isolation from the phenomenon of responsibility at all (in general) and its ontic conditions. The carried out analysis of the selected ontic conditions of taking responsibility demonstrates the conditions for taking ecological responsibility. This analysis allows to explain i.a. the close relationship between incurring ecological responsibility at the local and global levels. Ecological responsibility is always carried out at the local level but it has both local and global meaning due to the effects of complying or non-complying with ecological responsibility. These effects should be borne in mind in the process of making decisions about education, politics, or economy in such a way that that they do not increase the existing ecological risk.

W sytuacji globalnego kryzysu ekologicznego odpowiedzialność za stan biosfery (odpowiedzialność ekologiczna) jawi się jako jeden z najważniejszych obszarów ludzkiej odpowiedzialności. Nie sposób analizować fenomenu odpowiedzialności ekologicznej w oderwaniu od fenomenu odpowiedzialności w ogóle (w sensie ogólnym) i jej ontycznych uwarunkowań. Przeprowadzona analiza wybranych ontycznych warunków ponoszenia odpowiedzialności ukazuje warunki ponoszenia odpowiedzialności ekologicznej. Prowadzi ona m.in. do wyjaśnienia ścisłego związku pomiędzy ponoszeniem odpowiedzialności ekologicznej w wymiarze lokalnym i globalnym. Odpowiedzialność ekologiczna realizowana jest zawsze w wymiarze lokalnym. Ma przy tym i lokalne, i globalne znaczenie ze względu na skutki wywiązywania się lub niewywiązywania się z odpowiedzialności ekologicznej. Skutki te należy mieć na względzie w procesie podejmowania decyzji dotyczących edukacji, polityki, gospodarki czy ekonomii, tak by niosły one ze sobą jak najmniejsze ryzyko ekologiczne.

The evolution of the term “ecological quality” has been presented, starting from the general concept of quality to the place of ecological quality in the TQEM (Total Quality Environmental Management) concept. Ecological quality has been emphasised as an important expression of ecological competencies of a company. Ecological competencies are the basis for competition in the strategic dimension, with modern views on building competitive edge based on social responsibility of business entities and capacity of organisations to develop network connections. Network connections built with the CSR (Corporate Social Responsibility) concept taken into account may use sustainability competencies based on simultaneous use of economic, social and ecological competencies. In this way, ecological quality constitutes a component of sustainability competencies, which are the basis of a responsible business development and building responsible business models. These models may use a new approach to effectiveness, perceiving it not only in economic categories, but also in social and ecological ones. Responsible activities of business entities also lead to enhancement of quality of life. Responsible development of these entities, however, requires making responsible decisions which take into account social and ecological aspects as well.

Zaprezentowano rozwój pojęcia jakości ekologicznej poczynając od ogólnego pojęcia jakości do miejsca jakości ekologicznej w koncepcji TQEM (Total Quality Environmental Management). Zwrócono uwagę, że jakość ekologiczna stanowi ważny przejaw kompetencji ekologicznych przedsiębiorstwa. Kompetencje ekologiczne, w wymiarze strategicznym są podstawą do konkurowania, wykorzystując współczesne poglądy na budowę przewagi konkurencyjnej opartej o odpowiedzialność społeczną podmiotów gospodarczych oraz zdolności organizacji do tworzenia powiązań sieciowych. Powiązania sieciowe, budowane z uwzględnieniem koncepcji CSR (Corporate Social Responsibility — społeczna odpowiedzialność przedsiębiorstwa, biznesu), mogą wykorzystywać kompetencje sustainability, oparte o równoczesne wykorzystanie kompetencji ekonomicznych, społecznych i ekologicznych. W ten sposób jakość ekologiczna stanowi komponent kompetencji sustainability, będących podstawą odpowiedzialnego rozwoju fi rm oraz budowy odpowiedzialnych modeli biznesu. Modele te mogą wykorzystywać nowe podejście do efektywności, rozpatrując ją nie tylko w kategoriach ekonomicznych ale także społecznych i ekologicznych. Odpowiedzialne działania podmiotów gospodarczych prowadzą także do podniesienia jakości życia. Odpowiedzialny rozwój tych podmiotów wymaga jednak podejmowania decyzji odpowiedzialnych, uwzględniających również aspekty społeczne i ekologiczne.

Le maître dans l’œil du disciple. À propos de l’apprentissage ou de l’initiation écologique dans Les Neuf consciences du Malfini de Patrick Chamoiseau

Les Neuf Consciences du Malfini by Patrick Chamoiseau is a Bildungsroman centred around pedagogical experience of a disciple, and didactic and pedagogical achievements of a master. The educational process based on careful observation and formative imitation of the master, allows the novice to transcend his predatory impulses to reach the stage of ecological responsibility. Unlike the traditional Bildungsroman in which the master mobilizes some multisensory and multimodal devices to relay knowledge or truth, the novel in question confronts the reader with an archetypal "pedagogical" situation, where the master-disciple relationship is not interpersonal, interactive, voluntary or ritualized. Moreover, a pedagogical bond forms not only between the protagonists of the text, but also between the novel and the reader, its target audience. The paper proposes to approach the educational process and the master-disciple relationship from the point of view of ecocriticism, using semiotic analysis of  a character. It is argued that by means of the allegorical account, Chamoiseau criticizes anthropocentrism for being the main cause of ecological degradation and advocates horizontality in the human-nature relationship, as a guarantee of ecological balance.

Les Neuf consciences du Malfini de Patrick Chamoiseau est un roman initiatique articulé autour de l’expérience pédagogique d’un disciple et des prouesses didactico-pédagogiques d’un maître. Fondé sur l’observation minutieuse et l’imitation formatrice du maître, cet apprentissage permet à l’initié de transcender ses élans prédateurs pour accéder au stade de la responsabilité écologique. Contrairement au roman de formation traditionnel dans lequel le maître mobilise le dispositif multisensoriel et multimodal pour relayer le savoir ou la vérité, celui-ci met le lecteur devant une situation « pédagogique » archétypale où la relation maître-disciple n’est pas interpersonnelle, interactive, volontaire ou ritualisée. En outre, le lien pédagogique ne s’y déploie pas seulement entre les protagonistes mis en texte, mais aussi entre le roman et le lecteur qui en est la cible privilégiée. À l’aune de l’écocritique et de l’approche sémiologique du personnage, cette réflexion se propose d’étudier le processus d’initiation et la dynamique des relations maître-disciple pour montrer que, par ce récit allégorique, Chamoiseau fait le procès de l’anthropocentrisme comme cause principale du déclin écologique et préconise l’horizontalité dans les relations Homme/Nature, gage de l’équilibre écologique.
