A carrier’s tax accumulation consists of three aspects: structural, economical and legal. When it comes to the structural matters, the main issue is it’s being congruous with the constitution. Therefore tax accumulation must include the demand for tax justice and tax universality. The economical aspect of the tax accumulation of income is connected to the growing burden of taxation. On the other hand, it’s legal aspect mainly depends on obeying the rules of creating reasonable tax laws, meaning one that guarantees the efficiency of taxation. The implementation of tax liability is only possible when the proposition of tax substantive law contains precisely specified elements of the tax.

Kumulację podatkową podmiotową można omawiać w aspekcie ustrojowym, ekonomicznym i prawnym. Na gruncie ustrojowym zasadniczą kwestią jest zgodność z konstytucją normatywnej konstrukcji podatków. Kumulacja podatkowa podmiotowa musi zatem uwzględniać postulaty sprawiedliwości podatkowej i powszechności opodatkowania. Kumulacja podmiotowa dochodów w sensie ekonomicznym związana jest natomiast przede wszystkim ze zwiększonym ciężarem podatkowym. W przypadku progresywnej skali podatkowej kumulacja powoduje przewłaszczenie większej części dochodów, ponieważ im wyższa podstawa opodatkowania, tym wyższy podatek. Z kolei aspekt prawny kumulacji podatkowej podmiotowej łączy się głównie z przestrzeganiem zasad tworzenia racjonalnego prawa podatkowego, czyli gwarantującego skuteczność opodatkowania. Realizacja świadczenia podatkowego jest bowiem możliwa tylko wtedy, gdy norma prawa podatkowego materialnego zawiera precyzyjnie określone poszczególne elementy podatku.
