The aim of this paper is a comparative analysis of contracts on electric energy at Polish Power Exchange (POLPX) and European Energy Exchange (EEX) spot markets. The approach considered in this article is based on minimization of the Conditional Value at Risk and maximization of portfolio rates of return. The analyzed portfolios were constructed with contracts noted on POLEX and EEX from 1st January 2011 to 31st December 2012.

W artykule omówiono nową regulację dotyczącą praw konsumenta z perspektywy przedsiębiorstw energetycznych, zajmujących się sprzedażą bądź dystrybucją energii elektrycznej. Analizie poddano zakres zastosowania przepisów nowej ustawy, obowiązki informacyjne, szczególny tryb zawierania umów przez telefon oraz konsumenckie prawo do odstąpienia. Szczególną uwagę poświęcono tym przepisom ustawy o prawach konsumenta, które wywołują istotne wątpliwości z perspektywy relacji pomiędzy prawem energetycznym a prawem konsumenckim bądź z uwagi na uwarunkowania panujące na rynku energii elektrycznej.

This article discusses new Polish provisions on consumer rights from the perspective of energy enterprises involved in the sale or distribution of electricity. The analysis includes such issues as: the scope of the application of the Act on Consumer Rights; information duties; specific rules on concluding contracts by phone; and consumers’ right to withdrawal. Particular attention is paid to those provisions of the Act on Consumer Rights which cause particular doubts in the context of the relationship between energy law and consumer law or due to the conditions prevailing in the Polish electricity market.
