The Polish Investment Zone („PSI”) is a program supporting entrepreneurs in the form of income tax exemption. This program replaced the previously operating system of tax exemptions in special economic zones („SSE”). The amount of exemption available to investors is calculated as the product of the eligible costs and the intensity of the aid in the area of investment implementation. The purpose of this article is to present the observed approach taken for several years by tax authorities aimed at narrowing the catalog of eligible costs based on a non-normative act (tax clarification), together with the stance of administrative courts and with the presentation of the author’s own interpretation of the conflictual provisions.

Polska Strefa Inwestycji (PSI) jest programem wsparcia dla przedsiębiorców udzielanego w formie zwolnienia od podatku dochodowego. Program ten stanowi kontynuację systemu zwolnień podatkowych w specjalnych strefach ekonomicznych (SSE), w ramach którego podatnicy mogą korzystać z uprzednio przyznanych zwolnień maksymalnie do końca 2026 r. Kwota dostępnego zwolnienia dla inwestorów jest kalkulowana jako iloczyn kosztów kwalifikowanych oraz intensywności pomocy na obszarze realizacji inwestycji. Celem artykułu jest przedstawienie obserwowanego od kilku lat podejścia organów podatkowych, zmierzającego do zawężenia katalogu kosztów kwalifikowanych na podstawie aktu pozanormatywnego (objaśnienia podatkowe), wraz ze stanowiskiem sądów administracyjnych oraz przedstawieniem własnej interpretacji konfliktogennych przepisów.

The article describes the types of support tourism and recreation projects and agritourism in rural areas in Poland, with various activities and programs of the European Union. The support for rural tourism and agritourism from structural funds from the years 2004–2006, and from the Rural Development Programmes for the period 2007–2013 was characterized, too. The results of research conducted in the communities of two counties: Limanowa and Nowy Targ with employees of its municipal offi ces responsible for the promotion of the region and tourism development were presented. These studies focused on forms of support agritourism and rural tourism infrastructure from EU funds.
