In this paper the author presents an analysis of options for registering and allocating funds from the sale of rights to greenhouse gas emissions in the state budget, taking into account their volume and impact resulting from the preliminary estimates of selected research institutions and relevant EU legislation recommendations. The analysis applies to the EU countries, with a particular emphasis on Poland. It also describes proposed changes in the EU budget for 2014–2020 regarding climate policy and discusses new solutions in this field.

The paper contributes to the discussion on the possibilities of reducing greenhouse gases emissions from the sectors that are not covered by the European Union Emissions Trading System (the so-called non-ETS sectors). The author deals with some issues that should be taken into consideration while evaluating the validity of bringing additional sectors (i.e. transport, agriculture and buildings) into the European Union Emissions Trading System. Different approaches to including new sectors to the Emissions Trading System are considered. The research methods include descriptive and comparative analysis.

Opracowanie włącza się w nurt rozważań nad możliwościami redukcji emisji gazów cieplarnianych z sektorów nieobjętych Europejskim Systemem Handlu Emisjami. W artykule poddano pod dyskusję zasadność poszczególnych rozwiązań w zakresie ewentualnego włączenia do Europejskiego Systemu Handlu Emisjami trzech sektorów znajdujących się poza nim, tj. transportu, rolnictwa i użytkowania budynków. Zastosowane metody badawcze obejmują elementy analizy opisowej i porównawczej.

The subject matter of this article is the implementation in Poland of Directive 2003/87/EC on the emissions trading scheme for greenhouse gases in the Community. The first part of the article focuses on the presentation of the legislation and institutional arrangements which transpose the obligations contained in Directive 2003/87/EC into Polish law. On the basis of this, the article then presents some problems regarding the implementation in Poland of important changes introduced into Directive 2003/87/EC by Directive 2009/29/EC. This part of the article contains an analysis of Article 50 of the new Act on the System of Greenhouse Emission Trading, which introduces specific rules for licensing bodies that undertake investment in terms of compliance with the provisions of Directive 2009/29/EC. Secondly, this paper also presents a preliminary assessment of the proposed free allocation of greenhouse gas emissions allowances in Poland to electricity production enterprises. This is examined from the viewpoint of the possibility of State aid in the meaning of Article 107(1) of the Treaty on the Functioning of the European Union.

L’article traite de l’application en Pologne de la directive n° 2003/87/CE établissant un système d’échange de quotas d’émission de gaz à effet de serre dans la Communauté. La première partie de l’article présente les actes juridiques ainsi que les solutions institutionnelles nécessaires à la transposition de l’ensemble du contenu normatif de la directive n° 2003/87/CE en Pologne. Par la suite, l’article explicite certains problèmes liés à l’application en Pologne de modifications significatives de la directive n° 2003/87/CE introduites par la directive n° 2009/29/CE. Cette partie de l’article contient l’analyse de l’art. 50 de loi relatif au système d’échange de droits d’émission de gaz à effet de serre, lequel introduit des règles spécifiques concernant le système d’octroi de permis aux sujets entreprenant la réalisation d’un investissement, du point de vue de sa conformité avec les dispositions de la directive n° 2009/29/CE. L’auteur donne aussi une estimation préliminaire du plan d’allocation de quotas d’émission de gaz à effet de serre gratuits en Pologne aux entreprises de production de l’électricité sous l’aspect d’éventuelle aide d’Etat au sens de l’article 107 alinéa 1 du Traité sur le fonctionnement de l’Union européenne.

Przedmiotem opracowania są uprawnienia zbywalne do emisji gazów cieplarnianych, które, z natury rzeczy, są kluczowym elementem konstrukcji europejskiego systemu handlu emisjami, natomiast jego celem stała się identyfikacja, a następnie analiza formalnych (prawnych) i pozaformalnych przesłanek postrzegania uprawnień do emisji w kategoriach innowacji finansowych o zasięgu regionalnym (europejskim) i lokalnym (krajowym). Identyfikacja została poprzedzona naświetleniem istoty uprawnień i krótką ich charakterystyką, wzbogaconą elementami statystyki polskich aukcji uprawnień do emisji gazów cieplarnianych.

Tradeable greenhouse gas discharge permits are the subject of the study since, by nature, they represent the key component of the European emission trading scheme, whereas the purpose of the study is the identification and also the analysis of formal (legal) and non-formal reasons for approaching trading permits as financial innovations of regional (European) range and local (national) range. The identification was conducted by presenting the essence of the discussed permits and their brief characteristics, supported by the statistical elements from Polish auctions of GHG discharge permits.

Unia Europejska otwarcie aspiruje do odgrywania przywódczej roli na świecie w zakresie przeciwdziałania zmianom klimatu. W tym celu rozwija Europejski System Handlu Uprawnieniami do Emisji (EU ETS), który wymusza inwestycje w kapitałochłonne eko-technologie. Powiązanie zmian klimatu z bezpieczeństwem energetycznym wyraża nie tylko intencję ochrony środowiska naturalnego, ale bardziej jest wynikiem powiązań ekologii z interesami gospodarczymi poszczególnych państw członkowskich. Autor podejmuje próbę wyjaśnienia motywów oraz mechanizmów systemu EU ETS jako narzędzia polityki niskoemisyjnej UE oraz implikacji polityczno-gospodarczych dla państw członkowskich UE.

The European Union openly aspires to the role of the world leader in the fight against climate changes. This is why it is developing the European Union Emission Trading Scheme (EU ETS) promoting capital-intensive investments in eco-technologies. Bringing the issues of climate change and energy security together not only illustrates the need for protecting natural environment, but, even most importantly, it is a result of mutual relations between ecology and economy-related interests of particular member states. The author tries to explain the reasons and major mechanisms behind the EU ETS system as a tool of EU’s low-emission policy, as well as its political and economic implications for EU’s members.
