The article discusses the problems faced by employers and foreigners in the procedures for obtaining work permits. Among others, there is a lack of information for employers, a lack of information in languages understood by foreigners, an insufficient offer of free consultations, non-transparent procedures, long queues, extended deadlines for processing applications. The article based on an analysis of law, the author’s observations and research report data.

The article reveals the issues of modern bilateral legal regulation of labor migration between Ukraine and EU member states. Bilateral cooperation can be considered the most effective, because it takes into account the actual problems between the participants and is focused on specific subjects. The existing agreements are analyzed, their common and distinctive features are singled out, and the advantages and disadvantages of such agreements are revealed. The author substantiates the conclusion in the article that the Association Agreement does not grant Ukrainian citizens the right to free employment on the territory of EU member states and to free movement within the EU for this purpose. Nothing in the Association Agreement can be interpreted as such that acts as a basis for free employment of Ukrainian citizens. The author has analyzed the agreements that are currently in force with the member states of the European Union, and based on this analysis, he derived the author’s classification, which divides the agreements according to their key characteristics. According to the criterion, author distinguished four types of agreements: cooperation agreements (Belgium); migration flow management agreements (Spain); agreements on mutual employment of citizens and labor activity (Latvia, Lithuania, Poland, Czech Republic); temporary migration agreements (Portugal). The shortcomings of the relevant agreements and ways to improve the future content of such agreements have been identified. The author established interrelation between the agreements concluded in the same period and also allocated the questions which should be fixed in the future bilateral agreements. The article argues that international treaties governing the protection of the rights of migrant workers and employment regulate the basic procedural issues of employment of foreigners in their territory, the requirements for them, as well as the rights he is granted if such requirements are met. The author also identifi es ways to develop bilateral cooperation between Ukraine and EU member states, paying special attention to the following areas: development of the international legal framework with the member states of the Union; institutional cooperation; implementation of international and European norms and standards.

The shortage of employees in the economy is a phenomenon that is becoming more and more noticeable in developed countries. Many enterprises find it increasingly difficult to recruit employees from the domestic labor market, which is related to demographic changes and the mismatch between education system and market requirements. The solution to the problem is the employment of employees from other countries. Therefore the purpose of the article is to show that the employment of economic immigrants is one of many solutions to the problem of staff recruitment . The first part of the article discusses the impact of migration on labor market. Then the situation on the Polish labor market is presented. The final part of the article presents data on the employment of foreigners in Poland and the results of research conducted among Polish entrepreneurs on the employment of immigrants.

Niedobór pracowników w gospodarce jest zjawiskiem coraz bardziej zauważalnym w krajach rozwiniętych. Wielu przedsiębiorstwów ma trudności z rekrutacją pracowników z krajowego rynku pracy, co wiąże się ze zmianami demograficznymi oraz niedopasowaniem szkolnictwa do wymogów rynku. Rozwiązaniem problemu jest zatrudnianie pracowników z innych krajów, dlatego celem artykułu było przedstawianie, że zatrudnienie imigrantów zarobkowych stanowi jedną z dróg pozyskania pracowników. W pierwszej części artykułu omówiono wpływ migracji na rynek pracy. Następnie przedstawiono sytuację na polskim rynku pracy. Zaprezentowano także dane dotyczące zatrudnienia cudzoziemców w Polsce oraz wyniki badań przeprowadzonych wśród polskich przedsiębiorców na temat zatrudniania imigrantów.

The article covers issues related to the changes introduced to the Act of 20 April 2004 on employment promotion and labour market institutions, effective from 1.01.2018. The presented considerations refer to the issue of employment of foreigners in the territory of our country, which is important for the Polish labour market. The study focuses on two thematic blocks. The first of these is the permission for seasonal work, the second is the short-term work of foreigners in the Republic of Poland.

Artykuł obejmuje zagadnienia związane ze zmianami wprowadzonymi do ustawy z dnia 20 kwietnia 2004 r. o promocji zatrudnienia i instytucjach rynku pracy, obowiązujące od 1.01.2018 r. Prezentowane rozważania odnoszą się do istotnej dla polskiego rynku pracy kwestii, jaką jest zatrudnianie cudzoziemców na terytorium naszego kraju. Opracowanie koncentruje się wokół dwóch bloków tematycznych. Pierwszym z nich jest zezwolenie na pracę sezonową, drugim zaś – praca krótkoterminowa cudzoziemców w Rzeczypospolitej Polskiej.Słowa kluczowe: praca sezonowa, praca krótkoterminowa, zatrudnienie cudzoziemców, zezwolenie na pracę sezonową, procedura oświadczeniowa, wpis do ewidencji oświadczeń
