W artykule podjęto próbę analizy aktów prawa miejscowego jako prawnej formy działania administracji w ochronie środowiska. Autorzy zwracają uwagę na podstawy prawne stanowienia aktów prawa miejscowego, formy aktów oraz organy uprawnione do ich wydawania. Akty prawa miejscowego dają możliwość dostosowania prawa powszechnie obowiązującego do szczególnych i co ważne często zmiennych warunków lokalnych, co nie pozostaje bez znaczenia szczególnie dla ochrony środowiska.

The paper is an attempt to analyse enactments of local law as a legal form of administrative activity in the field of protection of the environment. The author points to the legal basis for issuing enactments of local law, the forms of these enactments, and the bodies authorised to issue them. Enactments of local law provide the possibility of adapting the universally binding law to particular and, importantly, often changing local conditions, which is essential for the protection of the environment.

According to the Constitution of the Republic of Poland, enactments of local law issued by the operation of organs shall be a source of universally binding law of the Republic of Poland in the territory of the organ issuing such enactments. In the Act on Voivodship Government the right to pass enactments of local law has been granted to provincial assembly as a constitutive organ of local government. Simultaneously, a voivodeship board has been deprived of the right to pass order regulations. In the period before the accession of Poland to the European Union a provincial assembly has had the strongest juridical position among the voivodeship authorities, but since that the situation has changed radically. On the basis of the Act of Regional Development a voivodeship board has gained wide juridical rights. The Constitutional Tribunal, during the process of the constitutional control of law, has formulated a lot of policies about legislation of a voivodeship board created on the basis of the Act of Regional Development. In the light of this jurisdiction a voivodeship board is not entitled to pass laws concerning the freedoms, rights and obligations of citizens. In addition to that, the resolutions of a voivodeship shall be of an internal character and shall bind only this organizational unit.

Konstytucja Rzeczypospolitej Polskiej do źródeł prawa powszechnie obowiązującego zalicza źródła prawa miejscowego. Są one stanowione przez organy jednostek samorządu terytorialnego lub terenowe organy administracji rządowej na podstawie ustaw i w ich granicach oraz obowiązują wyłącznie na obszarze właściwości organów, które je wydały. Ustawa o samorządzie województwa przyznała prawo uchwalania aktów prawa miejscowego sejmikowi województwa jako organowi stanowiącemu, pozbawiając jednocześnie zarząd województwa prawa do wydawania przepisów porządkowych. W okresie przed wejściem Polski do Unii Europejskiej dominującą pozycję w zakresie prawodawstwa wśród organów samorządu województwa miał sejmik. Sytuacja ta zmieniła się w sposób zasadniczy od chwili akcesji Polski do UE. Szerokie uprawnienia prawodawcze uzyskał zarząd województwa na podstawie ustawy o zasadach prowadzenia polityki rozwoju. Trybunał Konstytucyjny, w toku realizacji kontroli konstytucyjności prawa, sformułował szereg tez, odnoszących się do prawodawstwa zarządu województwa, delegowanych przez ustawę o zasadach prowadzenia polityki rozwoju. W świetle tego orzecznictwa należy przyjąć, że zarząd województwa nie może być adresatem delegacji ustawowej w zakresie materii zarezerwowanych wyłącznie dla ustaw kształtujących prawa i obowiązki jednostki, a uchwały zarządu mogą mieć jedynie charakter aktów wykonawczych prawa wewnętrznego.
