The aim of the article is to analyze the development of international legal standards concerning enforced disappearances. According to international human rights law enforced disappearances occur, when persons are deprived of their liberty, at least with the acquiescence of a state, which is followed by a refusal to acknowledge the deprivation or by concealment of their fate or whereabouts. The definition of enforced disappearances in the statute of the International Criminal Court covers also disappearances perpetrated by (or with at least the acquiescence of) political organizations.   The article consists of a thorough analysis of provisions contained in four legal documents: the Declaration on the protection of all persons from enforced disappearance, the Inter-American Convention on Forced Disappearance of Persons, the Rome Statute of the International Criminal Court and the International Convention for the Protection of All Persons from Enforced Disappearance.

Od 2014 roku we wschodniej Ukrainie (rejon Doniecka i Ługańska) dochodzi do poważnych naruszeń międzynarodowego prawa praw człowieka oraz międzynarodowego prawa humanitarnego. Najpoważniejszym problemem jest rosnąca liczba niewyjaśnionych zaginięć. W sierpniu 2015 roku Ukraina przystąpiła do Konwencji w sprawie ochrony wszystkich osób przed wymuszonym zaginięciem, a tym samym przyjęła na siebie szereg zobowiązań. W październiku 2016 roku Ministerstwo Sprawiedliwości Ukrainy przedstawiło projekt ustawy, który odnosi się do zagadnienia wymuszonych zaginięć. Problematyka niniejszego artykułu koncentruje się na analizie proponowanych rozwiązań oraz próbie oceny, czy zawarte w niej regulacje choć częściowo rozwiązują problemy prawne dotyczące wymuszonych zaginięć na Ukrainie.

Since 2014 in Eastern Ukraine (Donieck and Lugansk) there have been noticed serious violations of international human rights law and international humanitarian law. The most serious problem is growing number of disappearances. In August 2015 Ukraine joined the International Convention for the Protection of All Persons from Enforced Disappearance and in this way accepted particular obligations. In October 2016 Ukrainian Ministry of Justice presented project of new law that concerns enforced disappearance. The topic of this article is focused on analyses solutions that appeared in the project, and attempt to assess whether the solutions can be used to solve at least some of the problems concerning enforced disappearances in Ukraine.
