The article was dedicated to analyse the legal status of Engineer on the grounds of the FIDIC contract conditions. A major emphasis was put on specific description of the notion and legal character of Engineer, his rights and duties as well as responsibility possessed by him. What is more, the function of Engineer was juxtaposed with the investment supervision inspector on the ground of polish construction law. The article aims at presenting the key role of Engineer fulfilled in the process of realization with the use of FIDIC contract conditions.

Artykuł dotyczy statusu prawnego Inżyniera kontraktu występującego w warunkach kontraktowych FIDIC, ze szczególnym uwzględnieniem opisu pojęcia i charakteru prawnego Inżyniera kontraktu oraz posiadanych przez niego praw i obowiązków jak również ponoszonej przez Inżyniera odpowiedzialności. Ponadto funkcja Inżyniera kontraktu została zestawiona z inspektorem nadzoru inwestorskiego na gruncie polskiego prawa budowlanego. Artykuł ma na celu ukazanie kluczowej roli Inżyniera kontraktu, pełnionej w procesie realizacji inwestycji z wykorzystaniem wzorców kontraktowych FIDIC.

The importance of engineering pedagogical education for the global labour market has been characterized. The peculiarities of modern engineering pedagogical education formation in foreign countries consisting in economy globalization, transition to a high quality education and international cooperation enhancing have been presented. The essence of clothing engineering educators’ design competence being the professional’s ability to provide educational process with didactic design and productive one with technical documentation for the garment manufacture in accordance with the production norms and standards has been revealed. On the basis of regulations and national and foreign experience (the USA, Australia, South Africa, European countries etc.) in clothing engineering educators’ training the peculiarities of future professionals’ design competence formation as a constituent of professional competence has been clarified. Training of future professionals in “Professional Education” specialisation is the first stage in obtaining the engineereducator qualification (Eastern European countries). The second stage means gaining pedagogical qualification in vocational pedagogical educational establishments on the basis of obtained engineering qualification. The third stage consists in obtaining engineering and pedagogical qualification based on technical training according to the learning outcomes in International Society for Engineering Pedagogy that documents teachers’ qualification and competence and registers them in the international register of engineering educators.

The purpose of this publication is to determine the legal effect of the term reserved in Sub-Clause 20.1 of the FIDIC type for making an Engineer’s notification to the Engineer for a claim for an extension of the contract term or any claim granted under these FIDIC type conditions. The lack of a statutory definition of deadlines in the Civil Code of April 23rd, 1964, and other regulations, makes it difficult to define them. As a consequence, such a state of affairs makes it difficult to resolve the doctrine, case-law and construction practice, the dispute as to the effectiveness of shaping the will of parties to contractual deadlines (including the provision of FIDIC Sub-Clause 20.1). Thus the problem is not only theoretical and, most of all, practical. The decision to avoid the bankruptcy of many construction contractors, who are rarely the weakest party to the construction contract, is required to accept the contractual terms imposed by the Investor (such as Sub-Clause 20.1 FIDIC).
