Etyczny wymiar kryzysu odpowiedzialności globalnej

The paper discusses the relationship of the global responsibility crisis with values. The author shows that the source of this crisis is the loss of perspective defined by universal values. She uses the European concept of creativity and the Chinese concept of crisis /wej-dżi/ to show the ethical dimension of the crisis. She draws attention to the usefulness of the crisis for creative crossing the limits of what is possible as set by the current situation.

W artykule omówiono związek kryzysu globalnej odpowiedzialności z wartościami. Autorka pokazuje, że źródłem tego kryzysu jest utrata perspektywy określonej przez uniwersalne wartości. Korzystając przy tym z europejskiego pojęcia twórczości i z chińskiego pojęcia kryzysu wej-dżi, odsłania etyczny wymiar kryzysu. Zwraca uwagę na przydatność kryzysu do twórczego przekraczania granic możliwości wyznaczonych przez aktualną sytuację.

John Paul II addressed the issue of social problems very often in his teaching. Concerned about mankind and its universal development, he courageously spoke out on economics, management and politics. A remarkable place in the set of social problems raised by the Pope takes a process of globalisation. John Paul II first expounds on the cultural and ethical aspects of globalisation. If globalisation is for the good and progress of the human person, it must be a morally responsible process. It can be achieved through the realisation of solidarity, justice and fraternity that are a principle of coexistence, both in the individual and in the social dimension. Globalisation, like any other social phenomenon, is not an end in itself. It has a human purpose and must be a means and an effective instrument for building the good of the entire human family.

Materialny wymóg praworządności odnosi się do zawartości pryncypiów, walorów konstruowanych na podstawie kryteriów aksjologicznych i prakseologicznych przedmiotowych norm. W responsywnym podejściu chodzi o racjonalne i wybiórcze sięganie do sygnałów płynących z otoczenia prawa, jego dyskursywnej otwartości połączonej z adekwatną edukacją adeptów jurydycznych profesji w zakresie tytułowej problematyki. Ewolucyjnie dokonujący się rozwój refleksyjnego podejścia do prawa, z jego otwartością na wymiar etyczny, może utorować drogę do postrzegania godności jednostki w kategorii samoistnego wzorca i podstawy skargi konstytucyjnej.

The material requirement of the rule of law refers to the content of law, values constructed on the basis of axiological and praxeological criteria of law. The responsive approach is about rational and selective reaching for signals coming from the environment of rights, including the education of practitioners in the legal profession. All this takes place primarily on the basis of patterns having their source in the Constitution.
