This article discusses external openness of criminal proceedings in respect of legal security. The realization of such openness is done through the statutory permission to record and broadcast a hearing which is granted to representatives of the mass media. The article also attempts to assess amendments to article 357 of the Code of Criminal Procedure (2016) in terms its realization of the idea of legal security. The author gives a positive assessment of the direction of changes in the Polish law; however, she also tries to identify the legislation which could undermine legal certainty, and thereby negatively affect the possibility of realising the concept of legal security in the context of criminal law.

Niniejszy artykuł omawia kwestię jawności zewnętrznej postępowania karnego z perspektywy bezpieczeństwa prawnego. Przejawem urzeczywistniania się tejże jawności jest ustawowe zagwarantowanie przedstawicielom środków masowego przekazu możliwości utrwalania oraz transmisji przebiegu procesu. Opracowanie jest także próbą dokonania oceny nowelizacji przepisów prawa zawartych w art. 357 k.p.k. z dnia 10 czerwca 2016 r. pod kątem urzeczywistnienia wartości bezpieczeństwa prawnego. Autorka w sposób pozytywny ocenia kierunek zmian w polskim prawie, jednakże stara się też wskazać uregulowania prawne mogące godzić w pewność prawa, tym samym ujemnie wpływając na możliwość urzeczywistniania się idei bezpieczeństwa prawnego na gruncie prawa karnego.

This article discusses external openness of criminal proceedings from the perspective of legal security. Realization of that openness is manifested in a statutory guarantee of a possibility to record and transmit trial granted to representatives of the mass media. The paper is also an attempt to assess legal amendments contained in Article 357 of the Code of Criminal Procedure of 10 June 2016 in terms of realization of the legal security idea. The author positively evaluates the direction of changes in Polish law, however she also tries to identify legislation that could undermine legal certainty, thereby negatively affecting the possibility of realization of the legal security concept in the context of criminal law.
