Celem tekstu jest wskazanie podmiotów odpowiedzialnych za utrzymanie pasów przeciwpożarowych wzdłuż linii kolejowych w aktualnie obowiązującym porządku prawnym. Przedstawione zostały w nim rozwiązania prawne obowiązujące przed 30 czerwca 2010 r. oraz od 30 czerwca 2010 r. do chwili obecnej. Następnie zaprezentowano, jak obowiązująca obecnie regulacja jest interpretowana przez sądy administracyjne dwu instancji oraz jaki jest pogląd autora na temat podmiotów odpowiedzialnych za utrzymanie pasów przeciwpożarowych wzdłuż linii kolejowych.

The purpose of this paper is to show the entities responsible for the maintenance of firebreaks along railway lines in the current legal system. The text presents first the legal rules applicable before 30 June 2010 and those applicable ever since. The paper continues on to present how the currently applicable legal rules are interpreted by Polish administrative courts of two instances and what is the author's view of the entities responsible for the maintenance of firebreaks along railway lines.
