This article reveals the findings of research on students’s rights. The research was carried out twice: in 2006 and in 2012 among lower secondary school students. 223 participants from five schools have filled in the questionnaire form. This descriptive research show student’s knowledge, opinion and experience on how their rights respected In their schools.

I am in favour of the possibility of questioning the course of the legislative process in a constitutional complaint. The objection/the allegation could only concern the procedure of adopting a normative act containing a provision constituting the legal basis of an act of applying the law. The act of applying the law must concern the constitutional rights or freedoms of the complainant. With the current procedural regulation, I believe that there is an obligation to examine this issue ex officio by the Constitutional Tribunal. Practice shows that the Tribunal does not examine the correctness of the legislative process in the proceedings initiated by the complaint, neither on the allegation of the applicant nor ex officio.

Opowiadam się za możliwością kwestionowania przebiegu procesu legislacyjnego w skardze konstytucyjnej. Zarzut mógłby dotyczyć jedynie procedury przyjmowania aktu normatywnego, w którym zawiera się przepis stanowiący podstawę prawną aktu stosowania prawa. Akt stosowania prawa musi dotyczyć konstytucyjnych praw lub wolności skarżącego. Przy obecnej regulacji procesowej, uważam, że istnieje obowiązek badania tej kwestii przez Trybunał Konstytucyjny z urzędu. Praktyka pokazuje, że Trybunał nie bada prawidłowości przebiegu procesu legislacyjnego, w postępowaniu zainicjowanym skargą, ani na zarzut skarżącego, ani z urzędu.

The aim of the article is to present and characterise the essence of four fundamental pil-lars (the freedom of association, the self-governance, the independence and the equality) of trade union freedoms in the Polish legal system. The author presents such aspects as the classification of trade union freedoms or the characterisation of chosen specific union pillars. The article is based on the review of the relevant national legislation (in-cluding the Polish Constitution, international agreements and the Act on Trade of 23th May 1991), doctrine and judicature.
