Jedną z głównych zasad przygotowywanej obecnie nowej ustawy Prawo działalności gospodarczej jest zasada: „co nie jest prawem zabronione – jest dozwolone”. Przedmiotem artykułu jest spojrzenie na proklamowaną w  ustawie zasadę wolności gospodarczej przez pryzmat klauzuli dobrych obyczajów i wymogu staranności zawodowej, występujących w charakterze klauzul generalnych w ustawie o zwalczaniu nieuczciwej konkurencji oraz w ustawie o przeciwdziałaniu nieuczciwym praktykom rynkowym, a także w dotychczasowej i proponowanej ustawie o dzia- łalności gospodarczej i próba odpowiedzi na pytanie o wzajemną relację proponowanych zasad i konsekwencje projektowanej regulacji dla praktyki gospodarczej, w tym – potrzeby przejrzystości i jednoznaczności prawa oraz skuteczności ochrony „słusznych interesów innych przedsiębiorców i konsumentów”.

One of the main principles of the currently draxed legal act Law on Economic Activity is the principle: “what is not prohibited by law - is permitted” . The article is focused on the principle of economic freedom that is proclaimed in the Act through the prism of general clauses of good customs and the requirement of professional diligence that are present in the Act on unfair competition and the Law on combating unfair commercial practices, as well as in the existing and proposed Act on Economic Activity. It attempts to answer the question about the mutual relationship between the proposed rules and about the consequences of the proposed legislation for economic practice, especially - for transparency and ambiguity of law and e\ective protection of “the legitimate interests of other businesses and consumers”.
