The guerrilla strikes back: a comment on Yvonne Chiu

In a recent article Yvonne Chiu argues that nonuniformed combat is impermissible. However, her argument that by fighting without uniforms nonuniformed guerillas coerce civilians into participating in the armed conflict and thus into surrendering their immunity (their right not to be attacked) fails: there is no coercion, no participation, and no surrendering of immunity. Yet even if this argument of hers were correct, it would still not show that such “coercion” would amount to a rights infringement. Moreover, even if it did, there are examples that show that such an infringement would sometimes be perfectly justified. Finally, if she were right that forcing civilians into a moral position that they have not accepted or chosen is absolutely wrong, then this would affect the moral status of uniformed combatants no less than it would affect the moral status of nonuniformed ones.

В статье обобщаются некоторые малоизвестные факты деятельности парти- занских и летучих отрядов Польского Войска и Польской Военной Организации в Украине в 1918–1920 гг. Показана роль ПОВ в организации повстанческого и партизанского движения в Украине. Даны примеры как противостояния, так и сотрудничества ПОВ с украинцами.

Some little-known facts on the activities of guerrilla units and „flying squads” of Polish Army and Polish Military Organization in Ukraine in 1918–1920 are generalized in this article. The role of PMO in organizing rebel and guerrilla movement in Ukraine is shown. Examples of confrontation as well as cooperation between PMO and Ukrainians are presented.

W artykule uogólnia się niektóre mało znane fakty działalności oddziałów partyzanckich i lotnych Wojska Polskiego i Polskiej Organizacji Wojskowej na Ukrainie w latach 1918-1920. Pokazano rolę POW w organizacji powstańczego i partyzanckiego ruchu na Ukrainie. Podano przykłady zarówno konfrontacji jak też współpracy POW z Ukraińcami.
