The author analyzes the provisions of canon law shaping the relationship between the bishop and his subordinate clergy. The author comes to the conclusion that this relationship in various aspects does not meet the legal regulations about an employment relationship under Polish law. The bishop–presbyter relationship is different then the regulations known in secular law and belongs to the sphere of autonomy of the Church. Based on the provisions of canon law, it is also impossible to formulate and defend the thesis that the bishop has the ability, right and duty to comprehensively, comprehensively supervise the behavior of the clergy under his authority, especially in what is not part of their ministerial ministry.

Autor dokonuje analizy przepisów prawa kanonicznego kształtujących stosunki między biskupem a podległymi mu duchownymi. Dochodzi do wniosku, że relacja ta w różnych aspektach nie spełnia przesłanek prawnych stosunku pracy w świetle prawa polskiego. Stosunek biskup–prezbiterzy wymyka się regulacjom znanym w prawie świeckim i należy do sfery autonomii Kościoła. W oparciu o przepisy prawa kanonicznego nie można również sformułować tezy, że biskup ma możliwość, prawo i obowiązek kompleksowego czuwania nad zachowaniem podległych mu duchownych, zwłaszcza w tym, co nie należy do ich ministerialnej posługi.

The deliberations in this article concentrate on the issue of the legal character of obligatory contributions to the guarantee funds of banks and credit unions. The article explains the reason and the purpose of establishing the deposit guarantee scheme for banks and credit unions. Moreover, an attempt has been made to define the legal status of Bank Guarantee Fund and to explain the character of the legal acts – resolutions – issued by the Fund Council with regard to the amount of contributions to the guarantee fund of banks and credit unions. The said resolutions of the Fund Council on each occasion materialize the obligation of banks and credit unions to pay the contribution on the terms and conditions set therein.

Rozważania przedstawione w artykule skupiają się na problematyce charakteru prawnego obowiązkowej składki na fundusz gwarancyjny banków oraz kas. Z racji tego w artykule wyjaśniono istotę i cel tworzenia systemu gwarantowania depozytów dla banków i kas. Podjęto również próbę określenia statusu prawnego Bankowego Funduszu Gwarancyjnego oraz wyjaśnienia charakteru aktów – uchwał – wydawanych przez Radę tego Funduszu w przedmiocie określenia wysokości składek na fundusz gwarancyjny banków oraz kas. Rzeczone uchwały Rady Funduszu każdorazowo materializują bowiem obowiązek regulowania składek przez banki i kasy na zasadach tam oznaczonych.
