The judgment concerns the order in which the debts under the succession are to be settled, where the succession is to be accepted with limitation of liability. The author of the vote is critical of the statement that the inheritor should follow Article 1025 of the Code of Civil Procedure when regulating inheritance debts when determining the order in which they are settled. In the opinion of the author, the provisions of the inheritance law require the heir to satisfy proportional creditors excluding reserve institutions and records and instructions.

Wyrok dotyczy kolejności zaspokajania długów spadkowych, w przypadku przyjęcia spadku z ograniczeniem odpowiedzialności. Autor glosy krytycznie odnosi się do stwierdzenia, że spadkobierca regulując długi spadkowe przy ustalaniu kolejności ich zaspokajania, powinien kierować się art. 1025 Kodeks Postępowania Cywilnego. Zdaniem autora przepisy prawa spadkowego nakazują spadkobiercy zaspokajanie proporcjonalne wierzycieli z wyłączeniem instytucji zachowku oraz zapisów i poleceń.
