Celem opracowania jest analiza rozwiązań prawnych w zakresie ochrony zabytkowych pojazdów. Poruszono problematykę dotyczącą form ochrony tej grupy zabytków oraz wskazano na regulacje prawne, których zadaniem jest ochrona dziedzictwa kulturowego. Zwrócono uwagę na kwestie postępowania i opis procedury związanej z objęciem zabytkowych pojazdów ochroną prawną. Wyjaśniono także różnice w definiowaniu pojazdów jako zabytkowych, kolekcjonerskich i unikatowych. Nie pominięto również problematyki opieki nad zabytkowymi pojazdami oraz wynikających z niej obowiązków. Omówiono ograniczenia prawa właścicieli zabytkowych pojazdów do swobodnego dysponowania własnością, a także przedstawiono procedurę rejestracji pojazdu zabytkowego oraz wysunięto uwagi de lege ferenda. Artykuł ma charakter głównie źródłowy, uwzględnia aktualnie obowiązujące przepisy prawa w zakresie zabytkowych pojazdów.

The aim of the study is to analyse the legal solutions in the field of protection of historic vehicles. The problems concerning the forms of protection of this group of monuments were discussed, and the legal regulations concerning the protection of cultural heritage were pointed out. Attention was drawn to procedural issues and description of the procedure related to the legal protection of historic vehicles. The differences in defining vehicles as historic, collector’s and unique were also explained. Issues concerning the care for historic vehicles and the resulting obligations were also raised. Restrictions on the rights of owners of historic vehicles to freely dispose of their property were discussed, as well as the procedure for registering a historic vehicle and de lege ferenda comments. The article is based on sources, taking into account the current legislation on historic vehicles.
