After a long period of the native legal culture development, a systematic increase in the importance of the Bar in the social and political life of the country and the strengthening of its influence, there was a period much worse for lawyers. The loss of independence for more than one hundred years and the necessity of functioning in the structures of absolute monarchies caused many negative effects in the mutual relations between attorneys and their clients, primarily in the area of the legal professional privilege. Despite the fact that Poland regained its independence, the next century brought new, difficult challenges in the process of shaping the relations between lawsuit participants.

Po długotrwałym okresie rozwoju rodzimej kultury prawnej, systematycznego wzrostu znaczenia palestry w życiu społeczno-politycznym kraju oraz umacniania jej wpływów, nastąpił czas zdecydowanie gorszy dla prawników. Utrata niepodległości na ponad sto lat i konieczność funkcjonowania w strukturach monarchii absolutnych wywołały szereg negatywnych skutków we wzajemnych relacjach adwokatów z ich klientami, przede wszystkim w zakresie prawa do zachowania tajemnicy adwokackiej. Kolejne stulecie zaś, mimo odzyskania niepodległości przez Polskę, przyniosło nowe, trudne wyzwania w procesie kształtowania stosunków uczestników postępowania sądowego.

W artykule omówiono jeden z obowiązujących w okresie dwudziestolecia międzywojennego warunków wpisu na listę adwokatów, jakim było posiadanie nieskazitelnego charakteru przez osobę ubiegającą się o ten wpis. Przedstawiono zarówno genezę wprowadzenia tego wymogu, jak również znaczenie nadane pojęciu nieskazitelnego charakteru przez organy samorządu adwokackiego i orzecznictwo Sądu Najwyższego.

The article presents one of applicable requirements in the interwar period for the official registration of lawyers with the Bar, namely an impeccable character of the potential entrant. The genesis of the introduction process for the requirement, the meaning of an impeccable character as defined by the authorities of the Bar Council and case law of the Supreme Court are all raised and discussed.

The protection of a client’s interests in his relationship with a lawyer is an obligation of special importance, especially when we talk about maintaining the professional secrecy, without with a person granting the power of attorney could not have confidence that is necessary for the full use of his procedural rights. In the Polish systemic solutions the model of mutual relationships between the attorney and the client has been shaped for centuries and led to the conception of their bond that was believed to guarantee a wide protection of the rights that a party of proceedings is granted with before all courts. Chinese experiences are completely different, therefore the obligation that is included in the title is understood in a completely different way.

Ochrona interesów klienta w jego relacjach z adwokatem jest obowiązkiem o szczególnym znaczeniu, zwłaszcza gdy mówimy o zachowaniu tajemnicy zawodowej, bez której udzielający pełnomocnictwa nie mógłby zdobyć się na zaufanie konieczne dla pełnego wykorzystania przysługujących mu praw procesowych. W polskich rozwiązaniach ustrojowych model wzajemnych stosunków na linii adwokat-klient kształtował się przez stulecia, prowadząc do takiego rozumienia łączącej ich więzi, która daje rękojmię szerokiej ochrony praw przysługujących stronie w postępowaniu przed wszystkimi sądami. Chińskie doświadczenia są zupełnie odmienne, dlatego też tytułowy obowiązek jest tam pojmowany w zasadniczo różny sposób.
