The image is a personal good, which is protected in accordance with The Article 23 of the Civil Code. The need to protect a person's image is becoming more relevant, due to the fact that people are increasing their activity in the virtual world, by publishing a variety of information and images on the Internet. While adults can decide for themselves about the content they publish, children (especially the youngest ones) have no influence on the materials their parents make available. In the above situation, the state through regulations should protect the image of the youngest. So the main problem is to define: Do legal regulations sufficiently protect a child's image? Unfortunately, the current legal regulations have not kept up with social changes, especially those related to the virtual world. This article is primarily aimed at signaling the need to adapt legal regulations to social changes.

Wizerunek stanowi dobro osobiste, pozostające pod ochroną zgodnie z art. 23 k.c. Konieczność ochrony wizerunku człowieka staje się coraz bardziej istotna, z uwagi na fakt, iż ludzie zwiększają swoją aktywność w świecie wirtualnym, poprzez publikowanie różnorodnych informacji oraz wizerunków w Internecie. O ile dorosły człowiek może sam zdecydować o treściach publikowanych przez siebie, dzieci (w szczególności te najmłodsze) nie mają wpływu na udostępnianie materiałów przez ich rodziców. W powyższej sytuacji państwo za pośrednictwem regulacji prawnych powinno ochronić wizerunek najmłodszych obywateli. Zatem głównym problemem jest określenie: czy przepisy prawne wystarczająco chronią wizerunek dziecka? Niestety obowiązujące regulacje prawne nie nadążają za zmianami społecznymi, w szczególności tymi związanymi ze światem wirtualnym. Niniejsze opracowanie ma na celu przede wszystkim zasygnalizowanie potrzeby dostosowania regulacji prawnych do przemian społecznych.
