In the article analysis of the activity of the minor was taken in business trading which on the financial plain is giving rise to consequences in the income tax. Formal reasons forbidding minors the involvement in business trading aren’t predicted. However practical functioning of structures legal, enabling minors to conduct such activity, is raising doubts. A status is desirable for the entrepreneur about the full capacity to act in law. A capacity to act in law however limited of the entrepreneur, or her lack are problematic.

W artykule podjęto analizę aktywności małoletniego w obrocie gospodarczym, która na płaszczyźnie finansowej rodzi konsekwencje w podatku dochodowym. Nie przewiduje się formalnych powodów zakazujących małoletnim uczestnictwa w obrocie gospodarczym. Jednak praktyczne funkcjonowanie konstrukcji prawnych, umożliwiających małoletnim prowadzenie takiej działalności, budzi wątpliwości. Pożądany jest status przedsiębiorcy o pełnej zdolności do czynności prawnych. Problematyczna wydaje się natomiast ograniczona zdolność do czynności prawnych przedsiębiorcy lub jej brak.
