The article concerns the position of the National Council of the Judiciary in light of the Constitution of the Republic of Poland of 2 April 1997. The author analyses the constitutional basis for the functioning of this body and its tasks in safeguarding the independence of the courts and judges. The author draws attention to the changes that were introduced in the previous term of office of the Sejm with regard to the functioning of the National Council of the Judiciary. He criticises in particular the procedure for the election of judges to the National Council of the Judiciary by the Sejm, indicating that adopted regulations concerning this matter are inconsistent with the Constitution.

The article is a polemic with the text by A. Gomułowicz entitled A scratch on the face of Themis (“Kwartalnik Prawa Podatkowego” 2022, no. 2, pp. 29–38), which is a critical and at the same time a kind of gloss to the judgment of the Supreme Administrative Court of 4 November 2021 (III FSK 3626/21) concerning judicial (assessor) appointments with the participation of the current NCJ. This is a gloss written in the form of legal journalism combined additionally with a constitutional law lecture, the precision of which leaves much to be desired. As a result, the article contains a number of theses loosely inspired by the judgment of the Supreme Administrative Court (e.g., with regard to the Astradsson test) and put forward with disregard for the body of rulings of the Constitutional Tribunal and the doctrine of constitutional law (e.g., with regard to the prerogative of the President of the Republic of Poland). As a result, it should be concluded that the Author treats the issue raised in the NSA’s judgment too superficially, merely proclaims his convictions rather than trying to prove them. In this way, however, he has no chance of getting closer to the truth, which, as he declares, he values more than friendship.

Artykuł stanowi polemikę z tekstem A. Gomułowicza pt. Rysa na obliczu Temidy („Kwartalnik Prawa Podatkowego” 2022, nr 2, s. 29–38), który jest krytyczną, acz swoistą glosą do wyroku Naczelnego Sądu Administracyjnego z dnia 4 listopada 2021 r. (III FSK 3626/21) odnoszącego się do powołań sędziowskich (asesorskich) z udziałem obecnej KRS. Jest to glosa napisana w formie publicystyki prawniczej, połączonej dodatkowo z wykładem prawa konstytucyjnego, którego precyzja pozostawia wiele do życzenia. W efekcie w artykule pojawia się szereg tez stawianych nader swobodnie, co czyni je bardziej zbiorem refleksji luźno zainspirowanych wyrokiem NSA niż spójnym prawniczo wywodem (np. dotyczących testu Astradsson), albo tez stawianych z pominięciem dorobku orzeczniczego Trybunału Konstytucyjnego oraz doktryny prawa konstytucyjnego (np. w odniesieniu do prerogatywy Prezydenta RP). W rezultacie uznać należy, że autor nazbyt pobieżnie traktuje podjętą w wyroku NSA problematykę – raczej ogłasza tylko swoje przekonania, niż próbuje je udowadniać. W ten sposób jednak nie ma szans zbliżenia się do prawdy, którą – jak deklaruje – ceni sobie bardziej od przyjaźni.
