The aim of the article is to draw attention to the direct nature of the legal interest and to try to answer the question about the sources (grounds) of this interest. The analysis is carried out from the perspective of understanding individual interest in administrative law and focuses on the issues of qualifying legal interest, including law from the perspective of the nature of the relationship between individual interest and its normative basis, and from the perspective of the normative foundations forprotecting this interest. It also refers to the issue of the axiological determinants of directness legal interest in administrative law. The analysis here justifies the conclusion that the source of legal interest in administrative law comprises substantive norms belonging to the entire system of generally applicable law, which objectify the individual interest, and only the close relationship between individual interest and the legal norm which is the source of this interest allows such interest to be defined as a legal interest. The lack of a close relationship between the individual interest and the legal norm, which is considered as the source of this interest, allows such an interest to defined, from the perspective of administrative law, only as a factual interest. The close bond that must exist between an individual interest and the legal norm on which it is based in order for such an interest to be classified as a legal interest is expressed by the characteristic defined as the directness of the legal interest. The article also presents arguments to justify the thesis that the mere need to protect a legal interest, or even real protection provided to a legal interest in the area of civil law, does not constitute a source of legal interest in the area of administrative law. Just as the source of the legal interest should be sought in the norms of generally applicable law, the legislator decides on the protection and the degree of protection for this interest by establishing appropriate separate legal norms in this respect.

This paper does not aspire to offer an overall presentation of Prof. Jan Boć’s contribution to the concept of interest, but is intended to point out several views of this author on the design of legal interest in administrative law, including an attempt to assess their validity.Some of these views now require revising, others give them a fresh look. Professor Jan Boć commented on the relationship between public law and private law, made successful attempts to define the relationship. In the area of Professor Jan Boc’s academic interests, there has always been the individual, and therefore the Professor devoted considerable space in his work to the construction of legal interest of the individual, which went beyond the traditional definition describing the conceptof public interest.

The article concerns the issue of common good in the activity of public administration. It is exactly the aspects of this “good” which have a direct influence on the motives behind administrative actions. It turns out that what is “common” can be understood as pertaining to entire society, but also in relation to individual interests. The public administration, although traditionally connected only to the public interest, also implements the good of the individual and this not only indirectly, as it has been noted in the literature of the subject so far, but also independently. Because the common good has its different aspects in the sense that it does not have to mean only values of a strictly general dimension. This may be significant for the definitional purpose to the very administration itself and testifies, at the same time, to the multidimensional nature of contemporary public administration. The considerations are developed with reference to potential relations of public interest and the individual one, in which the most important place is occupied by conflict of these interests.

Overviewing the peculiarity of the public procurement procedure, including the matter of primate rules designating standards of the procedure itself, plays an important role in the context of public entities’ activity. The closer look at the essence of mutual relations between the principle of transparency and its restrictions enables to designate a catalogue of terms that justify the granting of protection for entrepreneur’s interest. By characterizing both the need to proper verification of the validity of the limitations over its effectiveness and participants roles in the proceeding, the purpose of the paper is to explore the specificity of the public procurement procedure. The following article provides the basic summary of the most crucial information constituting determinants for an entrepreneur who participates in the proceeding.

Omówienie właściwości postępowania o udzielenie zamówienia publicznego, w tym materii dotyczącej naczelnych zasad wyznaczających standardy procedury zamówień publicznych, stanowi niezwykle ważny aspekt w kontekście działalności podmiotów publicznych. Przybliżenie istoty wzajemnych relacji pomiędzy zasadą jawności a ograniczeniami w zakresie jej stosowania umożliwia wyznaczenie katalogu przesłanek uzasadniających przyznanie ochrony interesowi przedsiębiorcy. Zarówno wskazanie na potrzebę weryfikacji zasadności zastrzeżenia pod kątem jego skuteczności, jak i wyjaśnienie roli uczestników postępowania dodatkowo przybliża specyfikę postępowania. Artykuł zawiera podstawowe zestawienie informacji stanowiących wyznacznik dla przedsiębiorcy uczestniczącego w postępowaniu o udzielenie zamówienia publicznego.

Nowadays public interest clause is taken as indissolubly connected with public administration and its activity. Among other things it is used to describe, to qualify and define what is public administration itself and in what kind of matters its essence consist in. Public interest is a fundamental, pivotal notion in administrative law, but still – in spite of attempts undertaken even by the legislator to define this notion – it is not understood univocally. Public interest clause is a normative structure, it is a reference general clause. The most generally speaking, it is a directive applied to public administration organs, which should accomplish their tasks in the public interest. Public interest clause is reckoned among fundamental clauses for administrative law (meta-clauses), but it does not mean an ackowledgement of absolute primacy for public interest in public administration activity. One should remember about adequate weigh of public interest and interest of citizen (particularistic interest, interest of individual, individual interest), because there are specified, fundamental human rights and even there is an opinion that the notion of public interest acquires importance and gathers full of its content only if it is set together with the right/interest of individual.

Klauzula interesu publicznego jest współcześnie traktowana jako nierozerwalnie związana z administracją publiczną i jej działaniami. Wykorzystuje się ją między innymi podczas prób określenia, czym jest sama administracja publiczna i na czym polega jej istota. Interes publiczny jest pojęciem kluczowym na gruncie prawa administracyjnego, lecz nadal – mimo podejmowanych nawet przez ustawodawcę prób zdefiniowania tego pojęcia – nie jest ono rozumiane jednoznacznie. Klauzula interesu publicznego jest konstrukcją normatywną, o charakterze generalnej klauzuli odsyłającej. Najogólniej rzecz ujmując, jest ona dyrektywą kierowaną do organów administracji publicznej, które swoje zadania powinny wykonywać w interesie publicznym. Klauzula interesu publicznego jest zaliczana do klauzul zasadniczych dla prawa administracyjnego (meta-klauzul), co nie oznacza przyznania absolutnego prymatu interesowi publicznemu w działaniach administracji publicznej. Należy pamiętać o odpowiednim ważeniu interesu publicznego interesem obywatela (interesem jednostki, interesem indywidualnym), istnieją bowiem określone, zasadnicze prawa człowieka, a nawet można spotkać poglądy, iż pojęcie interesu publicznego nabiera pełnej treści dopiero wtedy, gdy zostanie on zestawiony z prawem poszczególnej jednostki.
