As a consequence of a rapid development of international trade online and subsequent exterritoriality of concluded transactions, traditional ways of dispute resolution become inadequate. In the globalized, virtualized world time-consuming and expensive judicial procedure is no longer applicable for the disputes arising from e-commerce. Therefore, other methods of dispute resolution have been adopted – such as international arbitration. Yet, the main characteristics of it differ – the procedure is handled online, it is less expensive, quicker, specialized and located in a particular trade platform. Connection with the market allows the materialization of the verdict by self-enforcement methods, existing on that internet platform.

International arbitration as the efficient means of alternative dispute resolution has become, due to globalization, a highly specialised service rendered by professionals. Master’s degree program (LLM) completion enables those interested to become competent and competitive specialists in arbitration on the international arena. Great Britain has accumulated broad practical experience in organizing professional training in the field of international arbitration. Many leading British universities offer prospective students Master’s programs in this speciality, encouraging all comers, even those with the initial non-legal background. Basic competences of LLM graduates in international arbitration (systemic competences, professional instrumental competences, professional social and personal competences) have been identified and clarified on the basis of relevant sources analysis. Professionally important knowledge, abilities and skills have been generalized and explained. For instance, an international arbitration LLM graduate is obliged to possess communicative and social skills, cognitive abilities and skills in the subject area, must be competent in English law, etc.

The Covid-19 global pandemic and the associated restrictions on the freedom of movement and association led to a de facto suspension of international arbitration hearings. In response to these restrictions, a practice of remote hearings began to emerge as the only viable option. However, in addition to technical issues, change to remote hearings raises a number of legal theoretical questions. In particular, whether a remote hearing sufficiently allows the parties to present arguments and evidence in support of their position; i. e., whether all the requirements of the due process can be met via remote hearings. In this respect, the practice of arbitral hearings has outpaced the legal theory. Now is the time to compare the two approaches and assess whether virtual hearings are indeed an appropriate and legal way of conducting arbitration hearings. And if so, does this mark the end of traditional in-person oral hearings?

Celosvětová pandemie onemocnění covid-19 a s ní související omezení pohybu a setkávání osob způsobily de facto přerušení mezinárodních rozhodčích řízení. V reakci na tato omezení se začala vytvářet praxe virtuálních ústních jednání, která se stala jedinou faktickou možností organizace ústních jednání. Přechod na virtuální ústní jednání však kromě problematiky technického zajištění virtuálního ústního jednání přináší také řadu právněteoretických otázek. Zejména zda virtuální ústní jednání poskytuje stranám dostatečnou příležitost předkládat tvrzení a důkazy ve svůj prospěch, tedy zda je možné ve virtuální podobě řízení splnit veškeré požadavky práva na spravedlivý proces. Praxe rozhodčích řízení v tomto ohledu předběhla jejich právní teorii. Nyní nastal čas tyto dva přístupy srovnat a posoudit, zda virtuální ústní jednání vskutku představuje vhodný a legální způsob vedení rozhodčího řízení. A pokud ano, znamená to konec tradičních prezenčních ústních jednání?
